MISSION VALLEY, San Diego (April 21, 2013) – In a recent CBS8 news article it was reported that two people were injured in a rollover crash in Mission Valley last night. The incident occurred at about 9:00 p.m. on the I-805 in the southbound lanes.  A truck hit a sedan that was in the process of changing lanes. This caused the sedan to swerve off the road and overturn.  Firefighters and medical personnel were called and rescue workers had to break one of the windows of the sedan in order to rescue the injured driver and passenger.  The extent of their injuries is unknown at this time. More information is forthcoming.

“Making lane changes is fraught with risk…Many times you can’t see nearby vehicles or they simply do not see you,” states West Seegmiller, founder and owner of The Seegmiller Law Firm.

SANTA ANA, California—Dale Snyder Quinn, a 75-year-old woman accused of having a blood alcohol content level of .22 percent, will be arraigned Friday morning for crashing her car into an 86-year-old man and killing him at an intersection inside Leisure World in Seal Beach.

According to the Orange County District Attorneys’ office, Quinn is accused of failing to stop at an intersection inside the Leisure World complex at approximately 5:40 p.m. on May 20, 2012. The defendant ignored three marked stop signs and two pedestrian-crossing signs and slammed into 86-year-old Robert Dillon who was crossing the street on his battery-operated scooter, said a spokesperson from the D.A.’s office.

Dillon was thrown from his scooter on impact and was transported to a hospital where he died eight days later from his injuries, said a D.A.’s  office spokesperson. Quinn was found sitting in her car and police say she displayed signs of intoxication including slurred speech, watery eyes and emitting an odor of alcohol.

Dale is charged with one felony count of vehicular manslaughter by lawful act that might cause death with gross negligence while intoxicated and if convicted, the D.A.’s office says she faces a maximum sentence of 10 years in state prison.

“There is no excuse for driving under the influence,” said Attorney West Seegmiller, founder of the Seegmiller Law firm. “Those who drive drunk and endanger the lives of others need to be held accountable for the damage and destruction they cause.”

Nationwide there were 10,228 deaths attributed to alcohol impaired driving in 2010 and while the numbers are staggering, the National Highway Transportation Safety Administration reports that deaths from drunk drivers were actually down nearly 5 percent in 2010 compared to 2009.

Teenagers love to talk on cell phones, but are they putting them away when they get behind the wheel of a car?

A new study indicates that many teenagers are not convinced that distracted driving is dangerous. According to a nationwide survey by Bridgestone Tires only half of the 2,000 drivers ages 15 to 21 who were surveyed as to whether they thought they were safe drivers said they thought distracted drivers were dangerous.

In fact, most reported that they themselves were not distracted behind the wheel of the car because they had taken extra precautions to avoid distractions, the survey reports. However, one out of every four teenagers surveyed said they don’t believe talking on a cell phone while they are driving is dangerous.

Indeed, one third (33%) of those surveyed admitted to reading text messages while driving and two thirds believed they were “very safe” drivers – but only half admitted their parents would agree with that assessment.

Overall teenage girls are far more distracted behind the wheel than boys, but more disturbing is the fact that the teens surveyed reported that their parents engage in distracted driving more than they do.

“Teenagers will not stop using their cell phones if they see their parents and other adults using them,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “Parents need to show a good example to their children from a young age if they want their teenagers to follow their advice.”

WASHINGTON – U.S. – Teenagers riding as passengers in cars are less likely to speak up about a distracted driver using a cell phone, according to a new survey released Monday by the National Highway Traffic Safety Administration.

The study found that younger passengers were less likely than older passengers to speak up about dangerous drivers using cell phones, the report said. Roughly a third of young passengers 18 to 24 years old said they would say something to a driver who was talking on a handheld phone compared to roughly half of drivers 65 and over who said they would speak up.

“There is no excuse to drive distracted,” Attorney West Seegmiller said. “Drivers who are distracted are as dangerous as those who are under the influence of alcohol, but sadly too many people believe they are the exception because they are a good driver.”

The NHTSA survey polled more than 6,000 drivers and found that approximately 90% of respondents consider a driver who was sending or reading text messages or e-mails as very unsafe.

“Distracted driving is an epidemic on our roadways, and these new findings show that our youngest drivers are particularly at risk,” said Secretary LaHood. “We’re encouraging young people across America to commit to distraction-free driving, spread the word to their family and friends, and speak up if the driver in their car is distracted.”

WASHINGTON, D.C.— Texting and driving is still taking place on our roadways despite awareness of its deadly consequences, but across the country new state laws are aimed at making the practice as unpopular as drinking and driving.

Indeed this week the state of Idaho became the 37th state to enact a texting while driving ban when Governor C.L. “Butch” Otter signed a distracted driving bill Thursday into law, according to a press release by the Governors Highway Safety Association. The bill will go into effect beginning July 1, 2012. Police will now be permitted to pull over drivers suspected of texting while driving without any other traffic offense committed.

One out of every five crashes in Idaho between 2007 and 2009 cite distracted driving as a contributing factor, according to the Idaho Office of Highway Safety. The new law is aimed at reducing the number of people injured and killed in the state.

In California, texting while driving is banned for all drivers and cell phone use must be done using a hands-free device. Additionally, California is one of six states that prohibit text messaging by novice drivers and one of three states to restrict school bus drivers from texting while driving.

According to the California Office of Traffic Safety, California’s traffic fatalities decreased 11.9% in 2010 to 2,715, down from 3,081 the prior year in 2009. This was the lowest level since the federal government began recording traffic fatalities in 1975.

Also, California’s hand-held cell phone law enacted in 2008 has helped law enforcement step up its efforts to combat distracted driving with cell phone law convictions up 22% from 361,260 in 2010 to 460,487 in 2011. Additionally, texting convictions increased 47 percent from 7,924 in 2010 to 14,886 in 2011.

“The many victims of distracted driving accidents are thrilled to see more states step up and enact texting bans,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “However, there is more work to be done as 13 more states still have no ban against texting and driving and no state has a complete ban on cell phones yet.”
