SAN BERNARDINO, California – A bicyclist riding in the early morning hours of Monday, January 9th, was struck and killed at the intersection of 3rd Street and Waterman Avenue by an unlicensed driver, according to a San Bernardino Police Department press release.
Upon arriving at the 5:31 a.m. bicycle crash, paramedics quickly transported Culverson, 61, of San Bernardino, to Loma Linda University Medical Center, however, he died the following day at 3:41 a.m., according to a San Bernardino County coroner’s report.
Benito Bustos-Gonzalez, 28, of Fontana, was the driver of the vehicle that struck and killed Culverson. He told police that he entered the intersection on a green light and did not see the bicyclist who police say was riding without a light on his bicycle before sunrise.
Police did not indicate whether Bustos-Gonzalez was cited for being unlicensed and reports did not mention whether he was arrested. Driving without a valid license is either a misdemeanor ($380 fine) or an infraction ($298 fine) in California.
• Under California Vehicle Code 12500 “(a) A person may not drive a motor vehicle upon a highway, unless the person then holds a valid driver’s license issued under this code, except those persons who are expressly exempted under this code.”
Sadly, many of these unlicensed drivers are also uninsured motorists. In fact, roughly 15% of California drivers are uninsured motorists. Victims of car accidents where an unlicensed and uninsured motorist is found negligent may have to sue a negligent driver personally to recover damages compensation for injuries or wrongful death.
“Police will usually conduct a complete investigation to determine who is at fault in a traffic accident, especially those involving a victim who has been killed,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm.
