SAN DIEGO, California (Feb. 21, 2013) –  A bicyclist suffered minor injuries Thursday morning after the rider was struck by the driver of a silver Nissan Sentra in the vicinity of the northbound Interstate 15 freeway and Via Rancho South, according to a dispatch report by the California Highway Patrol.

About 6 a.m., the CHP responded to the bicycle accident and called for the San Diego Fire Department to respond. The crash was blocking the No. 5 lane of the roadway. Paramedics were called to the scene to assist the bicycle rider with minor injuries.

According to the Centers for Disease Control and Prevention there are more than 500,000 people treated in emergency rooms due to bicycle-related injuries and roughly 700 are killed in accidents on bicycles.

Additionally, approximately 4 percent of all California accident-related fatalities (99 out of 2,715 people killed) were bicyclists, according to a report by the National Highway Transportation Safety Administration.

“Bicyclists are certainly more vulnerable than people who ride inside a vehicle that’s why it is so important for drivers to allow riders space when passing and to slow down when they see a bicyclist up ahead,” said Attorney West Seegmiller.

SAN DIEGO, California —  A 30-year-old man riding a bicycle was killed after he was struck by three separate vehicles in an early morning crash in the 6900 block of east Balboa Avenue on the overpass of the Interstate Route 805 freeway, according to a San Diego Medical Examiner Report.

According to the report, the man was riding his bicycle in the eastbound lanes of Balboa Avenue when he was struck by the driver of a Ford Expedition. The bicyclist was ejected from the bicycle and thrown into the street.  Next, the man was struck again by the drivers of two Toyota vehicles. Witnesses called 911 and paramedics responded to the scene, but the man was pronounced dead.

“Bicyclists are at a disadvantage on our busy roadways,” said San Diego Attorney West Seegmiller, founder of the Seegmiller Law Firm. “Drivers rushing to work in early morning commutes need to slow down and allow enough space in passing them on the road.”

Indeed California bicyclists had sought a new law last year SB 910 that would have required motorists to provide a 3-foot buffer between them and bicyclists on our roadways. Current law requires drivers to provide a “safe distance.” However, Gov. Jerry Brown vetoed the proposed legislation on Oct. 7, 2011.

Bicycle accidents killed 109 people and injured 11,993 in California, according to the California Statewide Integrated Traffic Report.  Los Angeles County was the worst with 22 deaths and 3,725 injuries, followed by Orange County with 12 deaths and 1,199 injuries and San Diego County with nine deaths and 972 injuries.

Police investigate every car or bicycle accident involving a death to determine the cause of a crash, Seegmiller explains. The investigation will seek to find out if drivers were under the influence of alcohol, medication, drugs or distracted as well as many other circumstances that may have led to the crash that were illegal or reckless.

“Families of victims killed in bicycle accidents not only have to cope with the loss of a loved one, but later their lives may be forever changed due to the loss of income and other costs,” said Seegmiller.

Bicycle Accident and Car Accident Statistics

There were 618 cyclists killed and 51,000 injured across the United States in 2010, according to the most recent statistics compiled by the National Highway Transportation Safety Administration.

In California, overall fatal traffic accidents were down 12% to 2,715 deaths in 2010 compared to 3,090 killed in 2009, according to statistics compiled by the National Highway Traffic Safety Administration. Additionally, national statistics show that traffic fatalities have declined in recent years across the United States, down roughly 3% to 32,885 deaths in 2010 compared to 33,883 killed in 2009.

“Bicyclists are especially vulnerable when they are riding during early morning and evening commutes because drivers are in a hurry and can be less focused on the roadways,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “Most of the time some sort of human error is responsible for car accidents.  Sometimes errors are innocent and other times they are reckless.”

Police investigate every bicycle accident involving a death to determine the cause of a crash, Seegmiller explains. The investigation will seek to find out if either the driver or the bicyclist was under the influence of alcohol, distracted or if there were any circumstances that may have led to the crash that were illegal or reckless.
