LAKE ELSINORE, California (Jan. 25, 2013) – Five young people were injured – three critically – after a single-vehicle crash on Chaney Street at Lakeshore Drive, according to a report by the Riverside County Fire Department.

About 12:34 a.m. on Friday, CAL FIRE/Riverside County firefighters responded to a call about an accident involving a single vehicle and multiple patients. Upon arrival, firefighters treated the patients and transported all five to a local hospital including three with critical injuries and two with moderate injuries, the report said.

The driver, Eduardo Barba, 18, of Lake Elsinore reportedly lost control of the vehicle, struck a retainer wall and flipped over. Police told the Lake Elsinore Wildomar-Patch that Barba was allegedly speeding and intoxicated at the time of the crash.

SAN JACINTO, California – William Steele, 41, of Homeland was killed Tuesday night in a fiery wreck after he struck another vehicle and lost control of his at the intersection of State Street and Esplanade Avenue, according to reports by CAL FIRE/Riverside County Fire Department and the Riverside County Sheriff Coroner Department.

Steele’s vehicle burst into flames and he was ejected in the crash as he was not wearing his seatbelt, according to the reports. Paramedics responding to the scene pronounced him dead upon their arrival, but noted that he suffered no burns in the wreck.  The fire burned for about 15 minutes until responding fire fighters managed to put it out.

The other driver was not injured in the crash and the two drivers were both alone in their vehicles, the reports said.

TEMECULA, California – Two people were injured early Monday morning after the driver of a dark green 2002 Chevrolet Suburban allegedly fell asleep and crashed into several cars on the northbound Interstate 15 freeway at the United States Border Patrol checkpoint just south of Temecula, according to a press release issued by the CAL FIRE/Riverside County Fire Department and California Highway Patrol reports.

According to the reports, one victim suffered major injuries in the 8:32 a.m. crash and the other was listed with moderate injuries. Emergency workers rescued one of the victims who was trapped inside a vehicle and both were transported to a nearby hospital for treatment of their injuries.

Police say driver David Arriaga, 20, of Riverside reportedly fell asleep behind the wheel of the Chevrolet Suburban and subsequently lost control of it as he veered into a Chevrolet Avalanche pickup truck. The truck was pushed onto its side and ran into a Mercedes-Benz sedan that was also waiting at the checkpoint.

Three fire engines responded to the scene with some 10 emergency workers on the scene of the multiple-vehicle crash.

“Drivers who fall asleep behind the wheel are considered negligent under California vehicle code and can be held liable for injuries and damages caused by a crash they cause,” Attorney West Seegmiller explains. “Indeed the crash is not intentional, but the driver is required to exercise the utmost care while in control of a motor vehicle and that includes refraining from driving when you are in no condition to drive.”

Additionally, national statistics show that traffic fatalities have declined in recent years across the United States, down roughly 3% to 32,885 deaths in 2010 compared to 33,883 killed in 2009.

BEAUMONT, California (RIVERSIDE COUNTY) –  A child was critically injured Saturday night after being struck by the driver of a car on a  small two-lane roadway in the 38000 block of Cherry Valley Boulevard at Union Street, according to a press release issued by the CAL FIRE/Riverside County Fire Department.

The Beaumont pedestrian accident took place in front of the Cherry Valley Nursery and Landscape Supply whose parking lot is alongside the roadway.

According to the fire department report, emergency workers responding to the scene of the 9:02 p.m. crash transported the injured victim to a nearby trauma center where the child was treated for moderate to major injuries.

“Police will indeed investigate this pedestrian accident to determine if the driver was in any way negligent and responsible for this child’s injuries,” said Attorney West Seegmiller. “The investigation will look into whether there were any circumstances contributing to the crash including whether alcohol, drugs or distractions were involved.”

California Pedestrian Accident Law

Negligent drivers who injure pedestrians can be held liable to the victim for costs of medical care, pain and suffering and lost income under California Vehicle Code Section 21950. Drivers are required to yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection. However, this requirement does not mean a pedestrian can suddenly run in front of traffic or unnecessarily stop traffic to cross the roadway.

Drivers need to exercise caution wherever there is a risk of children in the roadway and reduce speed when they are present as there is an inherent a risk of injury.

Pedestrians need to be especially cautious on our roadways because they are more vulnerable to injury or death. There were 32 pedestrians killed and 349 others injured in car accidents in Riverside County in 2010, according to the California Highway Patrol Statewide Integrated Traffic Report.  Overall there were 190 fatal crashes and 7,632 injuries reported in Riverside County.

In California, there were 598 pedestrians killed and 12,418 injured in 2009, according to the CHP traffic report.

National data compiled by the National Highway Transportation and Safety Authority shows that pedestrian injuries and fatalities in the United States were up 4.9% in 2010 to 4,280 deaths and injuries were up 19% in 2010 to 70,000 people injured.

WHITEWATER, California – (RIVERSIDE COUNTY) One person is dead and one critically injured after a sports utility vehicle collided with a big rig truck on the westbound Interstate 10 freeway early Monday morning, according to a press release issued by the CAL FIRE/Riverside County Fire Department.

According to the report, the driver of the SUV and a passenger were both trapped inside the vehicle after it crashed with the tractor trailer truck. Emergency workers arriving at the scene of the truck accident had to extricate them both from the vehicle as they were trapped in the wreckage.

The injured victim was quickly transported to a local hospital for treatment of undisclosed injuries sustained in the truck crash. The traffic collision took place in an area known for being one of the windiest areas of Southern California. Home to the San Gorgonio Pass Wind Farm, the area is midway between North Palm Springs and Cabazon.

Police investigate every car accident involving a death to determine the cause of a crash in order to find out the liable party, said West Seegmiller, a Riverside wrongful death attorney.  A driver can be found negligent and liable for injuries they cause if they do not exercise ordinary care while driving on our roadways.  In other words, their behavior was not intentional, but it fell below the standard of care required for motorists and someone was injured or killed as a result of their actions.
