LAS VEGAS, Nevada – A woman miraculously survived a 40-foot drop into a concrete flood channel Monday morning after driving through an open gate on a private road near Symphony Park Avenue and parallel to Interstate 15, according to a KLAS TV News 8 report.
The driver of a black BMW sedan was traveling on a private road that is normally block by an iron gate, but due to construction in the area the gate had been left open allowing her to pass through. She crashed through a fence and apparently landed right-side up.
After receiving a 911 call about 9:30 a.m. from the distraught driver, Las Vegas Firefighters responded to the scene of the crash located behind the World Market Center and rescued the driver from the dry concrete channel using a stretcher and a pulley system. Despite the fall, the woman suffered only minor injuries in the crash and she declined medical care, the report said. However, the report also indicated she was taken away by ambulance.
Las Vegas Police are investigating the crash, but they do not believe drugs or alcohol are a factor.
“Indeed this woman is fortunate to be alive after a harrowing plunge off the roadway,” said Attorney West Seegmiller. “Despite seemingly minor injuries a victim should always seek medical attention as some injuries surface 24 to 48 hours after a crash.”
Liability for Car Accident Victims
It appears at first blush that this crash may be the fault of the driver, but that may not be the case as only a complete car accident investigation will determine the party at fault. The vehicle was traveling on a private roadway, however, a dangerous condition may exist that could create liability on the part of the property owner. A gateway was open that is usually closed and a driver unknowingly entered through it and injured herself and damaged her vehicle.
