NEWBERRY SPRINGS, California —  Three months ago, driver Francisco Huesca, 19, was killed January 7 when he was ejected from his vehicle in rollover crash with a tractor trailer truck on Interstate 15, according to a San Bernardino County Sheriff’s report.

Huesca, 19, of Milpitas, was reportedly not wearing his safety belt, but new information obtained in a police report indicates that Huesca was indeed restrained in the crash.

“Our family received a final report done by the police stating that his seatbelt was faulty,” said Alberto Huesca Gonzalez, Francisco Huesca’s cousin.

Francisco Huesca and three passengers were driving his 1996 Toyota Corolla in the southbound lanes of the I-15, just north of Afton Road when he lost control of the vehicle for unknown reasons. The vehicle crossed the open center divider and went airborne before striking the side of a northbound tractor trailer truck. The Toyota rolled over and Huesca was ejected from the vehicle. The three passengers in Huesca’s car were treated for minor injuries at Barstow Community Hospital, the report indicated.

“The safety of motor vehicles has improved over the years because accidents such as this one have held car manufacturers liable in product liability lawsuits,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “Defective seatbelts, airbags, tires, etc. can cause fatal or serious crashes. Families of these victims should consider a lawsuit to bring justice to their loved ones.”

Overall fatal traffic accidents in California were down 12% to 2,715 deaths in 2010 compared to 3,090 killed in 2009, according to statistics compiled by the National Highway Traffic Safety Administration. Additionally, national statistics show that traffic fatalities have declined in recent years across the United States, down roughly 3% to 32,885 deaths in 2010 compared to 33,883 killed in 2009.

NEWBERRY SPRINGS, California —  Driver Francisco Huesca, 19, was killed Saturday, Jan. 7 after he was ejected from his vehicle in a head-on, rollover crash with a tractor trailer truck on Interstate 15, according to a San Bernardino County Sheriff’s report.

According to the coroner’s report, Huesca, 19, of Milpitas, was not wearing his safety belt at the time of the 2:33 p.m. crash. Huesca and three passengers were driving his 1996 Toyota Corolla in the southbound lanes of the I-15, just north of Afton Road when he lost control of the vehicle for unknown reasons.

Sadly statistics show that roughly half of the 639 deaths to unrestrained victims of traffic accidents could have been avoided if the people had just worn their seatbelts, according to a report by the National Highway Transportation Safety Administration. Most Californians do buckle up, some 96.2% in fact wear seatbelts in our state compared to the national average of 84%.

“It is heartbreaking to learn about any fatal car crashes, but particularly those of young people such as this young man,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm.
