WASHINGTON, D.C.— After nearly a decade of declining deaths for the nation’s newest drivers, a preliminary report on fatal accidents for 16 and 17-year-old drivers shows an 11% rise in the first half of 2011, according to a report released by the Governors Highway Safety Association (GHSA).

According to the report, the number of deaths rose from 190 in 2010 to 211 in 2011 – marking the end of an 8-year decline for deaths in this age group. The report data is gathered from all 50 states and the District of Columbia.

In their first year on the road, there were 93 deaths of 16-year-old drivers in the first half of 2011, up 16% when compared to only 80 killed in 2010 for the same six-month period. Additionally, 118 drivers aged 17 years old were killed, a rise of 11% compared to 110 in the previous year for the same time period.

Twenty-three states reported increases, 19 had decreases, and eight states and the District of Columbia reported no change, the report said. The largest increases were reported in Florida, Texas and North Carolina.

“While it is good news that overall deaths appear to have declined during the first six months of 2011, we are concerned that the trend with teens is going in the opposite direction,” said Troy E. Costales, Chairman of GHSA. ”As the report notes, a widespread strengthening of laws is still possible and finding effective tools outside of GDL is an important goal. These include improving driver education and involving parents in proactively establishing safe driving habits for their teens.”

Personal Injury Attorney West Seegmiller, host of the West of Legal radio show on KFWB News 980 in Southern California is a father of five adult children.

“As a parent who has raised five teenagers I can tell you firsthand that we must educate our children about the dangers of driving, limit nighttime trips, distractions in the vehicle and take away cell phones and other gadgets teenagers use behind the wheel,” Seegmiller said.

SANTA ANA, California – Roughly one year after she ran a red light and crashed into a car killing a 3-year-old girl, Soon Ok Lee, 66, of Irvine faced her arraignment Wednesday on charges of vehicular manslaughter with gross negligence.

Lee faces a maximum sentence of nine years in state prison if convicted on the charges which include a sentencing enhancement of causing great bodily injury. The charges stem from a Tustin car accident on May 15, 2011. Three-year-old Milena Avila suffered blunt force head trauma and was pronounced dead upon her arrival at the hospital. Her mother Catherine Avila suffered a fractured hip in the violent car crash.

According to the District Attorney’s press release, the crash took place about a year ago on May 15, 2011, at approximately 4:40 p.m.  The defendant Lee was driving in her 2008 Acura TL eastbound on Edinger Avenue approaching the intersection at Kensington Park Drive in Tustin.  Lee ran through a red light and crashed into 2002 Honda Accord with a family of three inside. The family in the Honda was making a legal left-turn on a green arrow light, from Edinger Avenue to Kensington Park Drive.

The impact of the collision caused the victim’s vehicle to spin around before it came to a stop in the middle of the intersection. Lee’s Acura ended up on the sidewalk at the southeast corner of the Tustin intersection.

IRVINE, California — Gotta text? Gotta make that call and forget to use your hands-free device? If you do it behind the wheel in Irvine on the first Thursday of each month this year be prepared to cough up $156 for a first offense and $279 for a second offense.

Beginning Feb. 2, the Irvine Police Department began stepping up its enforcement of distracted driving by dedicating themselves to ticketing violators who are not keeping their eyes on the road while driving. The police will conduct regular enforcement of distracted drivers on Thursdays in an effort to keep streets safer.

The police department tested the effectiveness of their distracted driver crackdown on Jan. 5 this year and efforts paid off. They issued 182 citations including 136 for distracted driving, mostly drivers using cell phones.

The National Highway Transportation Safety Administration said drivers who use hand-held devices are four times as likely to be involved in an injury related collision. In fact. In 2009, 5,474 people were killed on US roadways and an estimated 448,000 were injured in motor vehicle crashes that were reported to have involved distracted driving.

“Distracted drivers had better reconsider picking up that cell phone,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “It’s not worth a huge fine and it’s certainly not worth risking your life or someone else’s life.”

IRVINE, California – Traffic began backing up about 7 a.m. Wednesday morning after a single car flipped over and landed right side up in the grassy area beside the MacArthur Boulevard off ramp on the Interstate 405 freeway.

The female driver of a Nissan Versa lost control of her vehicle after she missed the off ramp and attempted to veer back and turn into the lane. Both driver and passenger were transported by ambulance to a local hospital for medical treatment with unknown injuries.

Traffic collisions take place on California freeways every one minute and 14 seconds, according to statistics compiled by the California Department of Motor Vehicles. In fact, in 2009, statistics show that there were a total of 426,228 traffic collisions including 2,805 that were fatal and 163,524 reported injuries.

“Motorists driving in early morning commutes need to stay alert and a good practice is to leave plenty of time to get to our destination,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm in Irvine.

If you are injured in a car accident and someone else was at fault for the collision you may need a lawyer to help you get compensation for your injuries, Seegmiller said.
