Driver Hits Canadian Man Crossing Highway 62

YUCCA VALLEY, California – Barney Brown, 79, of British Columbia, Canada, was struck and killed Wednesday night as he was crossing Highway 62 just west of Grand Avenue, according to a press release issued by the San Bernardino County Sheriff Coroner Department.

About 6:17 p.m., police say Brown was struck by the driver of a blue 2000 Dodge Dakota traveling eastbound in the No. 1 lane. Brown was walking in a southbound direction at the time of the pedestrian accident.

The San Bernardino County Fire Department paramedics pronounced Brown dead at the scene of the crash due to critical injuries he sustained. The pedestrian accident is under investigation by the San Bernardino Sherriff’s Department.

Under California law, drivers are required to yield the right-of-way to pedestrians crossing the roadway – even if they are crossing outside of a marked intersection, said Attorney West Seegmiller.

“Pedestrians may not dart out into traffic, but they may cross the road outside of a marked intersection where there is no other way to cross the street,” Seegmiller said. “Drivers must always be alert for pedestrians and slow down and allow them time to cross the road.”

“Most drivers carry car insurance not only because it is required under California law, but also because they want anyone who is injured in their vehicle to be taken care of in the event they are injured or killed,” said Attorney West Seegmiller. “Insurance companies, in turn, do not want injured victims to hire an attorney because studies have shown that victims represented by a lawyer recover 3.5 times more than those who deal directly with an insurance adjuster.”
