ORANGE COUNTY, California – At least one person was injured Tuesday morning after a motorcycle and a truck collided in the HOV lane of the State Route 91 freeway at Euclid Street, according to a dispatch report by the California Highway Patrol.

CHP officers arriving at the scene of the crash about 6:30 a.m. reported there was a truck in the HOV lane and the motorcycle was on the right side of the roadway, the report said. Orange County Motorcycle Accident Statistics

There were 19 people killed and 750 injured in Orange County motorcycle accidents in 2010, according to the California Highway Patrol Statewide Integrated Traffic Report.

“Riding a motorcycle in Orange County can be challenging,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “As a rider myself I understand the risks and I’ve had my own serious crash that required extensive medical attention.”

If another driver is at fault for your injuries they should be held accountable for your damages, Seegmiller said. Drivers carry vehicle insurance to protect those who may be injured so that they can be whole again. Independent studies have shown that those who have an attorney represent them typically get 3.5 times the compensation for their injuries than those who simply speak directly with insurance adjusters, Seegmiller explains.

California Liability Motorcycle Accidents

Motorcyclists who are injured or killed in a crash may not be liable for their injuries if the bike they are riding is defective or if repairs made to the vehicle fell below the standard of care. Motorcycle owners should also be aware when there are recalls due to faulty parts and ensure needed repairs are made. Motorcycle manufacturer BMW for example recently recalled 1,414 of its S1000RR sport bikes in April due to connecting rod issues.

BMW said the manufacturing error resulted in the connecting rod bolts possibly becoming loose during high engine temperatures. This defect and or high-engine operating speeds could result in catastrophic engine damage that could lead to handling issues and thus increasing the risk of a crash.

“Indeed, as a motorcycle rider myself it’s important to put safety first whenever you are on the road, however, the nature of these two-wheeled vehicles makes them more susceptible to a crash than a car,” said Attorney West Seegmiller, a wrongful death motorcycle accident attorney. “My sincere condolences to the family of this young man as they cope with such tremendous loss.”

In the United States, motorcyclist injuries made a significant drop, down roughly 9% to 82,000 injuries reported in 2010 compared to 90,000 injuries the year before. Fatal accidents were slightly up, 4,502 deaths were reported in 2010 compared to 4,469 in 2009.

Police investigate every car accident involving a death to determine the cause of a crash in order to find out who is liable to the other party for damages, said Attorney West Seegmiller. The investigation will seek to find out if either driver was under the influence of alcohol, drugs or distracted. Also, police are seeking to find out if there are circumstances that may have led to the crash that were illegal or reckless.

“Families of victims killed in car accidents not only have to cope with the loss of a loved one, but later their lives may be forever changed due to the loss of income and other costs,” said Seegmiller. “Every driver pays for insurance to cover themselves and passengers in case there is an accident because the victims will need money for their medical needs and so many other financial losses.”
