Dasilva was headed westbound on Hamilton Avenue when he collided with a Lexus sedan.  The driver of the Lexus remained at the scene to talk to police who made no arrests or citations.

Dasilva was taken to Western Medical Center in Santa Ana, where he was pronounced dead, according to the Register.

The cause of the collision is under investigation. Authorities are asking anyone who witnessed the collision to contact Huntington Beach traffic investigators at 714-536-5666.

Top 10 Things to do After a Car Accident

ORANGE COUNTY, California – It happens when you least expect it. Many drivers don’t see it coming because a car crash happens so quickly that a driver typically cannot respond.  While 259,899 crashes involved property damage, 163,524 people were injured and 2,805 were killed in crashes in 2009 here in California, according to statistics compiled by the California Highway Patrol’s Statewide Integrated Traffic Report.

Every driver should know what to do if they are involved in a car accident – even if it is a minor incident. Attorney West Seegmiller, founder of the Seegmiller Law Firm and host of the West of Legal show on KFWB News Talk 980 offers the following auto accident checklist to help those drivers who are involved in a car accident.

Orange County Car Accident Checklist:

  1. EMERGENCY KIT: Driving a car without an emergency kit is like crossing the street without looking both ways. It’s vital that your car is equipped with one that includes basic First Aid bandages and ointments. Fill out an emergency card with your health information on it including special medications you may require. Additionally, if you have a cell phone make sure it is always charged and with you when you drive. It can literally save your life one day. Paper and pen are essential for taking down notes including diagrams of the accident scene or exchanging information with witnesses or other drivers. Have a list of emergency contact numbers at hand or in your cell phone in case you are seriously injured. Basic items such as a flashlight, reusable camera and a set of orange cones, flares or warning triangles are also essential and can be kept in the truck of your vehicle.
  2. INJURY OR NO INJURY: This is the first question. Determine what you will do after a car accident based on whether there are injures and the severity. If you are involved in a traffic accident involving people who are injured you will need to first access the situation. If there are minor injuries, the best decision may be to move the vehicles involved to the side of the road so they are not subsequently struck again by another vehicle. Turn on hazard lights to alert other drivers. Some serious accidents involving neck or back injuries may require that the individuals remain where they until help arrives so they are not further injured. Emergency situations involving fire or the need for CPR intervention will require quick thinking to determine the best solution.
  3. INFORMATION EXCHANGE: Never overlook the importance of this step. Find out everything you can about the other driver. Starting with name, address, telephone number, insurance company, policy number, driver license number, license plate number, make and description of the vehicle. Find out if the vehicle belongs to the driver and if not note whether it’s a rental car, a company car or a friend or relatives vehicle. You will need to also gather information about these entities.
  4. WRITE YOUR ACCIDENT STORY: Start with a description of the vehicle including make, model and color including any interesting features. Ask the other driver what he thinks happened and write this down, but don’t give them your side of the story.  Never admit fault. Let the police determine fault based on the facts of the case. You write down your side of the story including the location of the crash, time, make a diagram and obtain any witness information such as name, telephone number, email, etc.
  5. PHOTOGRAPHS: Document the accident using photographs include all angles of the vehicles, license plates, witnesses, driver and passengers and debris including if there are any cell phones present. Take overall shots and detail shots of everything.
  6. POLICE AND ACCIDENT REPORTS: Some cities do not send police officers to respond to every accident that is reported. When there is no police officer responding to the scene of a crash the driver should file an accident report themselves with the city where it took place. In cases where a police officer responds to the crash he will write up a police report. Most insurance companies will request this form when a claim is filed.
  7. PERSONAL INJURY LAWYER:  Do you need a personal injury lawyer? If you need to see a doctor you probably also need to contact a lawyer. You will most often work with the insurance companies to handle your property damage claim, however, don’t make the mistake of putting your health in their hands. Indeed insurance adjusters want to settle your case for as little as possible. They are not going to worry about whether you have healed from your injuries, whether you lost wages while you were recovering or if there are any permanent injuries due to the crash. Instead they will make you an offer and push for a quick settlement at the lowest price possible. A personal injury lawyer will make sure you get the best treatment available, you completely recover and that you are covered physically and financially against any permanent health issues. A lawyer only gets paid if their client wins their case so it’s an incentive to make sure you are successful.
  8. MINOR INCIDENTS: Just a little fender bender? No need to report it to the insurance company right? Wrong. Always report the crash to the insurance company or risk having the other driver come after you later with a claim against you. Sure it may seem like it’s minor at the time of the crash, but later the other driver may later discover he or she has a neck or back injury and file a claim against you. If you haven’t gathered evidence and reported the crash you will be at a disadvantage. The other driver’s small dent may turn into a hefty repair bill and you could be sued.
  9. ACCIDENT JOURNAL:  You were involved in a car accident, you are injured and you are getting treatment for those injuries. At this stage, it’s important that you keep a daily and or weekly journal where you can maintain a record of your treatment including notes on how you are feeling and dates and times of doctor’s appointments. This journal will serve to help you the insurance company is reluctant to settle the case.
  10. RECORDED STATEMENTS: Never give a recorded statement to either insurance company.  Your personal injury lawyer is the only one you should speak to after a car accident. Your written or oral statement can be used against you and could affect your settlement negatively.
