SAN BERNARDINO, California (July 12, 2013) – There was a two-vehicle traffic accident late Friday afternoon on the eastbound side of Interstate 210, just west of Waterman Avenue, according to a dispatch report filed by the California Highway Patrol.

Just after 3 p.m., CHP officers received several 911 calls informing them of a collision between a gold Honda Accord and a grey Minivan.

Emergency officials arrived on scene and treated several people with minor injuries. Paramedics reportedly transported at least one person to a local hospital with unknown injuries.

The accident is under investigation by the California Highway Patrol.

“If you are in a traffic accident, whether major or minor, it is important to see a doctor,” said Attorney West Seegmiller of Seegmiler Law Firm. “Often times you may walk away from the accident seemingly unharmed, but days later start to really feel the effects. It is important to get checked out.”

SAN BERNARDINO, California – At least one person was injured Wednesday morning when a green Chevrolet Impala sedan crashed into a utility pole knocking it down and exposing wires on San Bernardino Avenue at Alabama Street, according to a dispatch report by the California Highway Patrol.

About 10:16 a.m., the CHP was called to the scene of the single-vehicle crash into a pole involving injuries, the report said. The CHP called for an ambulance for at least one injured victim, but no further details were available.

“Drivers crash into poles or traffic lights for many reasons,” said Attorney West Seegmiller. “Sometimes there are underlying problems with the vehicle due to manufacturer defects the driver may or may not know exist.”

In fact, the Chevrolet Impala was recently the subject of a recall by General Motors. The recall specifically targeted 36,413 vehicles made in the years 2008-12 due to issues with a defective control arm, according to the National Highway Traffic Safety Administration. The recall affected the police version of the car, however, these police cars are often resold to the public on used-car lots.

“A fractured control arm could lead to a loss of vehicle control and an increased risk of injury,” Seegmiller said. “The company notified owners on August 21, 2012, however, if the vehicle was purchased used it’s possible a driver may not have received notification of the defect.”

About 4:20 a.m., Ernesto Antonio Vera was driving his 2011 Nissan Cube in the westbound lanes of SR-58 at Kramer Junction Road or U.S. Route 395. Salazar was pronounced dead at the scene. The San Bernardino County Sheriff’s Department is investigating the collision.

MONTCLAIR, California — Nicholas Drew Royals, 22, of Ontario was struck and killed while riding his skateboard home from work early Monday morning on Benson Avenue just south of Moreno Street, according to a San Bernardino

The driver of a teal 1995 Nissan Sentra was driving behind Royals  in a southbound direction at about 35 miles per hour when he struck the skateboarder from behind. The driver pulled over and called 911 for police. Royals died at the scene of the pedestrian accident about 4:57 a.m.

In a police interview, the driver told authorities he did not see the skateboard rider who was reportedly wearing dark clothing at the time of the crash. Police say the driver did not appear to be under the influence of alcohol or drugs, but an investigation will be conducted by the Montclair Police Department.

Fatal Skateboard Accidents in the United States

There were 42 skateboard riders killed in 2011 including 30 who were struck by a vehicle or that involved a vehicle in some manner, according to the 2011 USA Skateboarding Fatality Report, a study compiled by Skaters for Public Skateparks, a non-profit skatepark advocacy organization located in Portland, Oregon.

Six of the vehicle-involved fatal crashes were in California, the state with the highest number of deaths totaling 11 in 2011.  Most of the people killed were young males ages 12 to 35 years old, only two victims were females, the report said.

“Skateboarders are pedestrians under California law and they have rights and drivers have duty to drive carefully when pedestrians are present,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “Distracted drivers are traveling on our roadways every day whether they are fiddling with the stereo, talking on a cell phone or reaching to grab something. Taking your eyes off the roadway for even a few seconds can result in deadly consequences.”

Families of victims killed in a skateboard accident have rights under California law too and it may be necessary for them to have an attorney investigate a crash to ensure there was no negligence involved, Seegmiller said.
