2 Caregivers Convicted of Abusing Autistic Man

Monday, May 20th, 2013

VISTA, California (May 20,2013) – According to an article in 10NewsSanDiego, two caregivers, registered nurse Dale Garritson, 62, and medical assistant Matthew Alexander McDuffie, 28, were convicted of abusing a severely autistic man under their care at Valley Center facility in San Diego. Garritson was convicted of two felony counts of willful cruelty to a dependent adult likely to cause great bodily injury as well as four other misdemeanor counts. He was placed on three years of probation and cannot practice nursing during this time. McDuffie was found guilty of two misdemeanor counts of willful cruelty to a dependent adult. The abuse consisted of poking victim’s eyes, bending and twisting arms, and pulling his hair.

“It’s great that these men were finally convicted and sentenced after such a long period of rampant abuse…we hope the victim’s family has obtained the justice they have sought- especially after entrusting a state run institution with the care of their son, only to be betrayed in this manner” states West Seegmiller, owner and founder of The Seegmiller Law Firm in San Diego.

LA MESA, California (May 14, 2013) – According to an article by 8NewsNow, a 1-year-old girl and her 2-year-old brother were found unconscious after drowning in a backyard pool in an east county pool home Monday morning. The toddlers were found unconscious in the back yard of a home located at the 10000 block of Sunset Avenue and Law Mesa at about 9:30 a.m.

According to sheriff’s officials, the woman and a male companion drove the two children to Sharp Grossmont Hospital where they were unable to revive either child. The little boy was transported to Rady Children’s and died at about 11:30 a.m.  The male who lived at the house was arrested after a marijuana grow house was found within. When authorities asked the man why he did not call an ambulance for the children sooner, his response was “I didn’t have a phone”.

“This is so tragic and these tiny children couldn’t stand a chance without the adult supervision they needed,” states West Seegmiller, founder of The Seegmiller Law Firm, a wrongful death law firm in San Diego.
