Tina Kohr, 20, of San Diego was killed in a rollover crash on Christmas Eve while riding as a passenger in a vehicle traveling on the northbound Interstate 15 Freeway, according to a press release issued by the San Diego Medical Examiner’s Office.

About 6:51 p.m. on Monday, Dec. 24, Kohr was traveling unrestrained in the backseat of a 1996 Toyota Camry heading northbound on the transition ramp of State Route 52 toward the I-15, the report said. The vehicle struck a guardrail and overturned onto its roof on the east side of the 15 Freeway.

Paramedics responded to the scene of the crash and found Kohr partially ejected through the back window of the Toyota, the Union Tribune newspaper reported.

Kohr was pronounced dead at the scene of the rollover crash, however the female driver and a front seat passenger survived with some injuries, the newspaper reported. Police said the driver was not under the influence of alcohol or drugs at the time of the crash.

“While a seatbelt may have saved this young lady’s life, the driver may still be held accountable to the family for driving negligently,” said Attorney West Seegmiller, founder of The Seegmiller Law Firm. “Families who lose a loved one in a crash due to someone else’s negligence can file a wrongful death claim to hold the liable driver accountable for their actions.”

Studies have shown that victims and their families who are represented by a personal injury attorney typically receive 3.5 times more in compensation in a lawsuit than they would if they work directly with an insurance company. Additionally, in some circumstances, a government entity can be held liable for allowing a dangerous condition that may have contributed to a person’s injuries or death.
