Motorcyclist, Bicyclist Critically Injured in Crash at Cooks Corner in Trabuco Canyon

Wednesday, October 31st, 2012

TRABUCO CANYON, California — Two men were critically injured in a crash Saturday morning between one man’s bicycle and the other’s motorcycle on Santiago Canyon Road, according to several news reports.

About 11:30 a.m., a 50-year-old bicyclist was riding behind his 13-year-old son about a mile north of Cook’s Corner when for unknown reasons the two vehicles collided sending both men into the roadway, the reports said. He suffered serious injuries and was transported to Western Medical Center in Santa Ana.

The motorcyclist, a single father who was on his way to work at the time of the crash, was taken by paramedics to Mission Hospital with severe injuries. One report indicated he was in a coma with multiple injuries including road rash.

The Orange County Sheriff’s Department’s major accident reconstruction team was called to investigate the collision.

“Cook’s Corner is a popular spot for both bicycle and motorcycle enthusiasts, but it’s also a deadly location for many traffic accidents,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “The families of these two injured riders should hire a personal injury attorney to investigate the cause of this crash and determine liability.”

As a motorcyclist, Seegmiiller knows first-hand how painful a crash can be as he went through one himself and underwent painful medical treatment to remove road rash from his arms he got from skidding across the pavement.

“The experience was extremely painful and one I never forgot,” said Seegmiller, who is now an advocate for victims of traffic accidents who often are under compensated by insurance companies that want to quickly settle their cases.

Orange County Traffic Accident Statistics

Roughly 3 percent of the 100 traffic-related deaths in Orange County were bicyclists in 2010, statistics show. Motorcyclists account for 19 percent of the deaths and 32 percent were pedestrians, according to statistics compiled by the California Highway Patrol’s Statewide Integrated Traffic Report.

Additionally, there were 13,368 people injured in Orange County in 2010 including 750 to motorcyclists; 1,187 bicyclists and 770 pedestrians.

Halloween Haunted Houses and Homeowner’s Liability

Wednesday, October 31st, 2012

These days neighborhood trick-or-treating has gone way beyond the ghoulish displays of skeletons, flashing purple lights and smoldering candles flickering inside pumpkins.

Indeed, children were once happy just collecting candy door-to-door and a parent’s biggest concern was whether their child may be given tainted Halloween candy or a razor blade hidden in an apple.

But lately Halloween has evolved for both children and adults as homeowner’s displays are upgraded into haunted houses and mazes that people can walk through as they make their way through the neighborhood.

However, anytime a homeowner invites people onto their property there is a chance that someone could be injured and ultimately the property owner can be held liable.

“Homeowners who create these types of mazes or attractions in their home need to make sure they are covered by their insurance in the event someone is injured,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “Making sure that electrical cords are properly taped down to prevent tripping is one way of ensuring guests are safe in your haunted house.”

Let’s say for example a child walking through your haunted maze does trip and break their leg. Certainly most homeowner’s insurance companies are going to cover the medical costs in this situation, but it’s wise to check with your insurance agent first before something happens.

According to the North Carolina-based Haunted House Association there are an estimated 2,000 haunted attractions charging admission that operate every year in the United States. Roughly 8,000 people on average attend each of these facilities. There are also about 1,000 single-day events operated by charities in October.  Amusement parks and family fun centers also get into the spirit of Halloween by operating some 300 haunted events during the season, according to HHA.

In one case, a woman paid to enter a haunted maze in a corn field and was chased by a scary creature wielding a chainsaw that was actually turned on. As she ran away from the character screaming, the woman slipped in the muddy field and broke her leg. She sued the maze operator, but the court ruled against her citing the fact that she was aware of the risk involved by entering the corn field and she assumed that risk of injury.

“The outcome of this case is similar to ones where someone engaging in a dangerous sport is injured under normal circumstances would not be able to obtain compensation,” Seegmiller said. “However, if the owner of a maze or haunted house is found negligent due to a dangerous condition they could be held liable for resulting injuries.”

By the way, parents need not worry about their children getting poisoned Halloween candy from strangers as it turns out there have never been any documented cases of such a thing, according to pediatricians Aaron Carroll and Rachel Vreeman at Indiana University School of Medicine.
