California Pedestrian Accident Law

Under California Vehicle Code Section 21950 (a) a driver must yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, said Attorney West Seegmiller, a California attorney. Also, drivers are required to slow down when a pedestrian is in the roadway and be alert for any crossings.

“There are exceptions in the law, however, such as pedestrians are required to watch out for their own safety,” Seemiller said. “This means they cannot suddenly leave a curb and walk or run into the path of a vehicle. Also, pedestrians should not unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.”

However, if a pedestrian does step into the roadway suddenly the driver must still make every effort to safely stop or avoid hitting them whether it’s a marked or unmarked crosswalk, Seegmiller said.

Monday, July 1st, 2013

RESEDA, California, (July 1, 2013) – Several vehicles had severe damage in Reseda Monday morning when the driver of a pickup truck overturned onto parked cars after swerving to avoid a black car that ran a red light, according to a dispatch report filed by the California Highway Patrol.

Just before 1:45 a.m., CHP officers received several 911 calls informing them that a black vehicle ran a red light sending a large maroon pickup truck into park vehicles at the intersection of White Oak Avenue and Sherman Way.

No injuries were reported, though emergency personal did respond to the scene.

The pickup truck crushed at least one parked car and severely damaged three other vehicles in an attempt to avoid a head-on collision with the black car that ran a red light and fled the scene.

The investigation is ongoing, as officers search for the black vehicle.

“It is sad to think that something as commonplace as running a red light at an intersection can have such devastating effects,” said West Seegmiller, owner and founder of The Seegmiller Law Firm. “If you are injured or have property damage as a direct result of someone else, you deserve to be compensated.”
