Rollover Crash in Mission Valley Injures Driver and Passenger

Sunday, April 21st, 2013

MISSION VALLEY, San Diego (April 21, 2013) – In a recent CBS8 news article it was reported that two people were injured in a rollover crash in Mission Valley last night. The incident occurred at about 9:00 p.m. on the I-805 in the southbound lanes.  A truck hit a sedan that was in the process of changing lanes. This caused the sedan to swerve off the road and overturn.  Firefighters and medical personnel were called and rescue workers had to break one of the windows of the sedan in order to rescue the injured driver and passenger.  The extent of their injuries is unknown at this time. More information is forthcoming.

“Making lane changes is fraught with risk…Many times you can’t see nearby vehicles or they simply do not see you,” states West Seegmiller, founder and owner of The Seegmiller Law Firm.

Steven Williams Killed and Family Injured in Off Road Vehicle Crash in Mojave Desert

Thursday, April 19th, 2012

SAN BERNARDINO COUNTY, California (Mojave Desert)  –  Steven Brent Williams, 30, of Rohnert Park died of injuries sustained in an off-road vehicle rollover crash that also injured his wife and their two young children Wednesday night at the Johnson Valley OHV Recreation Area, according to news reports and a press release issued by the San Bernardino County Coroner Department.

San Bernardino County Firefighters responded to the crash site and pronounced Williams dead at the scene of the crash about 7:45 p.m. The three others injured in the crash were transported to a local trauma center with minor to moderate injuries.

According to a Press-Enterprise news article, the family, which included a 1-year-old boy and a 3-year-old girl, was riding together in a modified 1965 Jeep. They were all reportedly ejected when the vehicle rolled over multiple times.  The family was reportedly camping in the vicinity and were taking a ride in order to find cell phone reception to make a call, the article said.

The California Highway Patrol is investigating this incident.

Michael Donofrio of Seal Beach Killed in Off Road Crash near Calico Ghost Town and Barstow

Monday, March 12th, 2012

CALICO, California – Michael J. Donofrio, 42, of Seal Beach died Saturday night in an off-road ATV motor-vehicle accident about a mile east of 36600 Ghost Town Road in Calico, according to California Highway Patrol and the San Bernardino Coroner’s press release.

Donofrio sustained upper body trauma in a 10:47 p.m. crash and was transported by paramedics to Barstow Community Hospital where he was pronounced dead at 11:43 p.m. The CHP is investigating the crash to determine its cause.

The popularity of off-road vehicles continues to rise as do the number of injuries sustained by those who enjoy them.  According to the U.S. Consumer Product Safety Commission there were 310 reported deaths and 115,000 emergency room treated injuries to riders of ATV’s in the United States in 2010. The number of children under 16 years old reported killed on these motor vehicles was 55 or 17% of the total deaths for the year. There were also 28,300 injuries reported to children under 16 or 25% of the total.

“Indeed ATV’s  have become a fast-growing weekend sport among Californians and others,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm in Irvine. “There were some 400,000 ATV’s in operation in 1985, but the latest statistics show there are now some 9.2 million in operation throughout the United States.”

Police investigate every car accident involving a death to determine the cause of a crash, Seegmiller explains. The investigation will seek to find out whether there was any criminal activity involved, another driver, alcohol, distractions, dangerous conditions or recklessness on anyone’s part.

“Families of victims killed in car accidents not only have to cope with the loss of a loved one, but later their lives may be forever changed due to the loss of income and other costs,” said Seegmiller. “The victim of any accident deserves a full investigation into the incident to determine the cause and whether anyone is responsible.”

LUCERNE VALLEY, California — Motorcycle racer Lance Black was killed Sunday after losing control of his bike during an 85-mile racing competition held at Johnson Valley, an off-road enthusiast playground in San Bernardino County, according to a county coroner’s report.
Black, 45, of Brea, who is described as an elite racer with many years experience, was found about 150 feet off the motorcycle course about 1:15 p.m. and was pronounced dead at the scene from his injuries, the report said.
A veteran motorcyclist, Black was competing in the 44th annual National Hare and Hound Championship Series off-road competition sanctioned by the Desert Motorcycle Club, a non-profit sanctioned by the American Motorcyclist Association as a District 37 Club.
The race began at 9:30 a.m. with the first 40-mile run that included competitors of all ages from 12 to seniors. The race was followed by a second 35-mile loop with a narrowed field of riders to adults only. The final 15-mile loop was mostly experienced riders under 50, according to the Desert MC website. The report did not indicate which leg of the competition Black was found.
The race was dedicated to the memory of Wes Finkle who died in a previous race in 2010. The competition was the first part of two races competitors must complete in order to win, the second race is scheduled to be held on February 12 at Spangler Hills in Ridgecrest.
“Riders who enter these types of competitions are typically asked to sign a release of liability in order to compete,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “Depending on the circumstances this type of release may protect the event organizers from liability.”
Indeed off-road racing can be an inherently dangerous sport and riders who compete assume a certain amount of risk of injury or even death when they participate in such contests. However, there are incidences where others are held liable for a participant’s injuries. The courts have ruled that liability for injuries or death in sports activities can apply in cases where another participant or the event organizer intentionally does something that causes the accident. Also, liability applies if another participant engages in conduct so reckless as to fall completely outside the range of ordinary activity for that particular sport.
