LAS VEGAS, NEVADA- Martin Martinez Killed in Rock Quarry Accident in Sloan, South Las Vegas, OSHA Investigates

LAS VEGAS, NEVADA (November 18, 2013) – Rock Quarry worker, Martin Martinez, 49, died last week in an accident while on the job. The incident occurred when Mr. Martinez  sustained fatal crushing injuries while working in a rock quarry in the community of Sloan, South Las Vegas.

The Las Vegas Police responded to a call at about 2 p.m. at the rock quarry located at Sloan Road.

Occupational Safety and Health Administration officials (OSHA) are investigating the accident and the causes for Mr. Martinez’s death.

“It is my hope that the Martinez family will obtain legal representation in this matter,” states attorney West Seegmiller. Mr. Seegmiller has been practicing personal injury and wrongful death law in the Las Vegas area for over 35 years.

SAN DIEGO, CALIFORNIA: Two Serra High School Football Coaches Dressed in Blackface for Halloween Party Offend Many People

SAN DIEGO, CALIFORNIA: (October 29, 2013) – A photo has gone viral that depicts two Serra High School football coaches dressed in blackface at a Halloween party. Witnesses stated that they also saw the two coaches, Harold Seeley and Brian Basteyns wearing the blackface costumes at a game at San Diego State University last Saturday.

“We cannot have coaches leading young students and passing on their racism,” states president of the NAACP’s San Diego chapter. News Crews actually approached the homes of the men involved in order to get their side of the story but neither individual came to the door.

Basteyns recently took the pictures down from their Facebook pages and replaced them with these words: “I am absolutely mind boggled right now. He who is without sin shall cast the first stone. Feeling disappointed.”

Sally Smith’s husband Frederick Schucht was allegedly fired without cause last year from Serra High School.  She filed a complaint against Basteyn when she witnessed him screaming obsceneties at the players during a game. Smith says her complaint was ignored.

10News attempted to contact the school district for comments and more information but spokesman Jack Brandais said he did not have any comments for the media.

CORONA: Anaheim Man, 34, Killed in Accident at Asphalt Plant

CORONA, California (Oct. 8, 2013) — Anaya Rolando, 34, of Anaheim was killed Monday afternoon when he became tangled in a conveyer belt of a machine that crashes asphalt while working at the Asphalt Plant in the 25200 block of Maitri Road, according to a press release by the Riverside County Sheriff.

About 12 p.m., Rolando was working at the R.J. Noble Company’s Asphalt Batch Plant when for unknown reasons he was pulled into the machine and became entangled, the report said.

The Riverside sheriff’s department and Cal-OHSA are investigating the fatal accident to determine what happened.

“Most accidents that take place while someone is working on the job are covered under a workman’s compensation claim, however, there are some incidents that allow for a separate claim against a third party,” said Attorney West Seegmiller. “It depends upon the circumstances for each individual case.”

LA JOLLA, SAN DIEGO: Two Workers Injured in High-Rise Condo Transformer Explosion

LA JOLLA, SAN DIEGO (October 1, 2013) – Two electricians were injured today at a La Jolla high-rise condominium complex when an apparent transformer explosion occurred. The explosion was reported to have gone off at about 11:30 a.m. this morning at the 900 block of Coast Boulevard, according to San Diego Fire-Rescue. Two ambulances and medical personnel responded to the scene. The two injured electricians were transported immediately to UC San Diego’s burn unit, according to 10News. The electrical workers were working on the first floor of the building when the explosion occurred.  Coast Boulevard and Jenner Street remained closed until the fire was contained.

“The electrical workers that were contracted to work on this building need to know what their legal rights are. Security Guard Fired After Speaking with Media About His Heroic Deed

Security Guard Victor Bailey Helped Homeless Woman; Violated Company Policy as he Spoke to Media

SAN DIEGO, California (August 30, 2013)- A female victim of sexual assault was lured into a man’s vehicle and then he tried to rape her. Victor Bailey, a shelter security guard at an East Village homeless shelter, was able to console and help the woman. Bailey called 911 for her. Later, Baily agreed to be interviewed by 10News where he shared his story and feelings about the incident. Baily told reporters that crimes against the homeless, especially women are all too common and the public needs more awareness.

A day after the interview, Baily was chastised for having spoken with the media, and he was even fired from his job as a security guard. He was informed that he had violated a policy in which shelter employees cannot talk to the media without approval. Bailey was not aware of this policy, he states he was fired two weeks after he was reprimanded. Bailey was also very recently diagnosed with prostate cancer. He had a solid record of being on-time for his job, and not missing work.

“There may be something occurring here that had less to do with Bailey’s interview and more to do with the fact that he was recently diagnosed with a terminal illness. It may have been in the interests of the homeless shelter to let him go based on this fact”, states attorney West Seegmiller. “Mr. Bailey’s rights may have been violated as he may have been discriminated against due to his health status.”

Bob McElroy, president of The Alpha Project, which runs the winter homeless shelter that employed Bailey assured the media that Bailey’s termination was only the result of his media interview.
