Mohsen Mirfakhraie, 90, Killed in Irvine Pedestrian Accident

IRVINE, California (March 8, 2013) — Mohsen Mirfakhraie, 90, of Irvine was killed Friday night after being struck by a driver while crossing at the intersection of Trabuco Road and Monroe, according to a press release issued by the Orange County Sheriff Coroner Department.

About 6:20 p.m., police say the driver of a 2005 Toyota Camry crashed into Mirfakhraie as he attempted to cross Trabuco Road, the Orange County Register reported. The driver remained at the scene where the 90-year-old pedestrian was pronounced dead by paramedics upon their arrival.

Police shut down Trabuco Road between Culver Drive and Yale Avenue in order to conduct a complete investigation into the pedestrian accident.

California Pedestrian Accidents

Under California Vehicle Code Section 21950 (a) a driver must yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, said Attorney West Seegmiller, a California and Las Vegas wrongful death attorney. Also, drivers are required to slow down when a pedestrian is in the roadway and be alert for any crossings.

“There are exceptions in the law, however, such as pedestrians are required to watch out for their own safety,” Seemiller said. “This means they cannot suddenly leave a curb and walk or run into the path of a vehicle. Also, pedestrians should not unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.”

However, if a pedestrian does step into the roadway suddenly the driver must still make every effort to safely stop or avoid hitting them whether it’s a marked or unmarked crosswalk, Seegmiller said.

Man in 20s Killed in Anaheim Pedestrian Accident

ANAHEIM, California  – A pedestrian was struck and killed early Friday morning after being struck by an SUV in the eastbound lanes of Lincoln Avenue, according to a report in the Orange County Register.

About 12 a.m., on Friday, Jan. 4, 2013, a man in his 20s was walking on Lincoln Avenue which passes over the 57 Freeway when for unknown reasons he was struck by the driver in the SUV. The male driver remained at the scene of the Anaheim pedestrian accident and spoke with police investigating the collision, the Register reported.

“Under California Vehicle Code Section 21950 (a) The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.

(b) This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.”

VICTORVILLE: David Rivera Killed After Wheelchair Struck by Car

VICTORVILLE, California – David Rivera, 40, of Hesperia was killed Tuesday night by the driver of a Jeep who for unknown reasons veered off the roadway and struck his motorized wheelchair, according to a press release issued by the San Bernardino County Sheriff-Coroner Department.

Rivera was riding in his wheelchair heading northbound on 7th Avenue just south of Manzanita Street about 9:53 p.m. when the crash took place, the report said. Paramedics responding to the scene of the crash pronounced the Hesperia man dead upon their arrival.

The San Bernardino County Sheriff’s Department Major Accident Investigation Team is investigating this collision.

“Under California law, people who ride in wheelchairs, ride skateboards or bicycles are considered to be pedestrians,” said Attorney West Seegmiller. “All motorists therefore have a duty to exercise care when they are present.”

SAN DIEGO, California – Daniela Lopez, 22, was struck and killed by a car Tuesday afternoon as she was crossing the street near the intersection of Logan Avenue and 49th Street, according to a San Diego County Medical Examiner report.

Paramedics responded to the scene of the crash and initiated advanced life saving measures and transported her to the hospital emergency department. Despite aggressive effort to save her life, she could not be revived and death was pronounced in the trauma unit, the report said.

“Motorists are required by law to yeild the right of way to a pedestrian crossing the roadway whether they are in a marked or unmarked crosswalk at an intersection,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm.

Under California Vehicle Code Section 21950, however, pedestrians also have a duty on roadways to exercise due care for his or her own safety. “No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.”

It is incumbent upon a driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk that they exercise all due care and reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian, the law says.

Under no circumstances does the requirement that pedestrians exercise due care does that “relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.”

Indeed, drivers are typically responsible to victims of pedestrian accidents and liable for their injuries financially, Seegmiller said.

Pedestrians need to be especially cautious on our roadways because they are more vulnerable to injury or death. There were 57 pedestrians killed and 937 others injured in car accidents in San Diego County in 2009, according to the California Highway Patrol Statewide Integrated Traffic Report.  Overall there were 217 fatal traffic accidents and 12,993 injuries in 2009 in San Diego.

In California, there were 598 pedestrians killed and 12,418 injured in 2009, according to the CHP traffic report.

National data compiled by the National Highway Transportation and Safety Authority shows that pedestrian injuries and fatalities in the United States were up 4.9% in 2010 to 4,280 deaths and injuries were up 19% in 2010 to 70,000 people injured.

Carmen Pineda Killed in Riverside Pedestrian Accident

RIVERSIDE, California — Carmen Pineda, 37, was struck by a full-sized pickup truck and killed Thursday as she walked on the dirt shoulder of Arlington Avenue just west of Fairhaven Drive about 12:30 p.m., according to a Riverside County Coroner report.

According to news sources, the Dodge pickup truck hit Pineda after swerving off road in an effort to avoid a head-on crash with a black pickup truck that the driver said crossed over the center lane into oncoming traffic. Pineda was transported to Riverside Community Hospital where she died of her injuries about 1:30 p.m., according to the coroner report.
