FATAL ONTARIO CRASH: Five Men in 20s Killed in Car Accident

Tuesday, September 4th, 2012

ONTARIO, California – Five young men were killed in a single-vehicle rollover crash into a residence early Sunday morning on South Haven Avenue just south of East Creekside Drive and early reports indicate that speed, alcohol and distracted driving were possibly factors in the crash, according to news reports and a press release issued by the San Bernardino County Sheriff Coroner Department.

All five victims died about an hour after the 1:41 a.m. crash. Jonathan Watson, 21, was reportedly driving the 2005 Nissan Sentra at the time of the crash when he allegedly ran a red light on Haven Avenue before crashing into a home. Some news reports indicated that the driver may have been tweeting while behind the wheel as his passenger’s Tweets reportedly indicated that was the case, but police have not confirmed it.

“Police will investigate whether there were any other factors involved in the crash including other vehicles involved, speeding, alcohol or distracted driving,” said Attorney West Seegmiller, a personal injury attorney. “Attorneys can also conduct their own investigation into the crash and solicit telephone records to confirm whether a driver was texting and driving.”

Marquell Bogan, 23, of Ontario was transported by emergency workers to Kaiser Hospital in Ontario where he was pronounced dead at 2:24 a.m.

The other four victims all died at the scene of the crash. Ervin McKinness, 21, of Ontario died at  2:14 a.m., the report said.

Also killed were Dylan George, 20, of Ontario whose injuries resulted in his death at the scene of the crash. Watson, 21, of San Bernardino died at the scene at 2:36 a.m. due to injuries sustained in the crash. JaJuan Bennett, 23, of Rancho Cucamonga also died at the scene of the deadly crash about 2:32 a.m.

The car crash is being investigated by the Ontario Police Department and the San Bernardino County Sheriff’s Coroner’s Division is conducting an investigation into the deaths.

“As a father of five grown children myself I sympathize with the families of these young men as they cope with such incredible loss,” Seegmiller said. “Hopefully other young people will learn from this in the future as no parent should have to lose a child in this manner.”

The family and friends of the many victims are holding a car wash fundraiser on Sept. 5 through Sept. 8 at Archibald’s Restaurant on 2685 E Riverside Drive.

WHITEWATER: One Dead, One Critical in Crash Between SUV and Big Rig on I-10 Freeway

Monday, August 20th, 2012

WHITEWATER, California – (RIVERSIDE COUNTY) One person is dead and one critically injured after a sports utility vehicle collided with a big rig truck on the westbound Interstate 10 freeway early Monday morning, according to a press release issued by the CAL FIRE/Riverside County Fire Department.

According to the report, the driver of the SUV and a passenger were both trapped inside the vehicle after it crashed with the tractor trailer truck. Emergency workers arriving at the scene of the truck accident had to extricate them both from the vehicle as they were trapped in the wreckage.

The injured victim was quickly transported to a local hospital for treatment of undisclosed injuries sustained in the truck crash. The traffic collision took place in an area known for being one of the windiest areas of Southern California. Home to the San Gorgonio Pass Wind Farm, the area is midway between North Palm Springs and Cabazon.

Riverside County Car Accident Statistics

According to California Statewide Integrated Traffic Report there were 190 fatal crashes and 7,632 people were injured in 2010 in Riverside County. Additionally, Riverside reported 12,809 crashes involving property damages.

In California, fatal traffic accidents were down 12% to 2,715 deaths in 2010 compared to 3,090 killed in 2009, according to statistics compiled by the National Highway Traffic Safety Administration. Additionally, national statistics show that traffic fatalities have declined in recent years across the United States, down roughly 3% to 32,885 deaths in 2010 compared to 33,883 killed in 2009.

Riverside Car Accident Investigation

Police investigate every car accident involving a death to determine the cause of a crash in order to find out the liable party, said West Seegmiller, a Riverside wrongful death attorney.  A driver can be found negligent and liable for injuries they cause if they do not exercise ordinary care while driving on our roadways.  In other words, their behavior was not intentional, but it fell below the standard of care required for motorists and someone was injured or killed as a result of their actions.

“Distracted drivers, sleepy drivers or those eating or fiddling with personal belongings while behind the wheel would be considered negligent under California law,” Attorney West Seegmiller explains. “It’s not intentional, but it falls below the standard of ordinary care required under California law.”

The investigation will also seek to determine if a driver was under the influence of alcohol, drugs or distracted while using a cell phone or other electronic device. Also, police are seeking to find out if there are circumstances that may have led to the crash that were illegal or reckless.

“Families of victims killed in car accidents not only have to cope with the loss of a loved one, but later their lives are hindered due to the loss of income, funeral and medical costs,” said Seegmiller. “Every driver is required to have insurance in case they are in a car accident so they can assist and support financially anyone who is injured or killed.”

Elba Escobar Killed, Two Injured in Los Angeles Food Truck Accident

Thursday, March 22nd, 2012

LOS ANGELES, California – Elba Escobar was killed and two others were injured after the food truck she was driving allegedly ran a red light and collided with a Mercedes Benz on Washington Boulevard in downtown Los Angeles, according to several news reports by NBC and the LA Weekly.

Escobar, 55, of Los Angeles, was driving the 1984 GMC truck eastbound on Washington when she crashed into the 1991 Mercedes traveling westbound attempting to make a left-hand turn onto Union Street. The crash sent the food truck into a traffic light pole and a fence where it overturned and Escobar was trapped in the vehicle. The Mercedez smashed into a nearby retail store.

Escobar, a married mother of three children, was pronounced dead at hospital shortly after the crash. A 38-year-old Los Angeles woman who was a passenger in the food truck suffered minor to moderate injuries in the crash and was transported to a local hospital where she was listed.

The 61-year-old driver of the Mercedes suffered a non-life threatening head injury and was also transported to a hospital for treatment.

Los Angeles Car Accident Statistics

According to the annual California Statewide Integrated Traffic report there were 554 fatal and 50,817 injury traffic accidents reported in Los Angeles County in 2009. Additionally, there were 2,805 fatal and 163,524 injury crashes in California in 2009.

“Driving in Los Angeles county can be particularly dangerous due to the high volume of cars on the roadways that lead to congestion and ultimately accidents,” said Attorney West Seegmiller, a Los Angeles car accident lawyer. “Indeed this is a tragedy for the family of Elba Escobar as well as the other injured victims involved in the car crash.”

Police investigate every car accident involving a death to determine the cause of a crash, Seegmiller explains. The investigation will seek to find out if there was anyone driving under the influence of alcohol, distracted or if there were any circumstances that may have led to the crash that were illegal or reckless.

Who is liable in a car accident?

Indeed a Los Angeles Car Accident Attorney could recover damages for the victims of this crash including medical bills, loss of wages or income and more. However, there are statutes of limitations that must be met in order to file a lawsuit and make a claim with the insurance companies that represent these drivers. These statutes limit the time period allowed for a victim of a car crash to file a claim against another driver for negligence.
