Driver Ran Red Light, Crashes into Two Motorists Killing 3 People, Injuring 4 Others

UPDATE: Shawn Michael Scott, 33, of Fontana, and Helen Terry Amaya, 33, of El Monte Identified as Two Adults Killed in Crash

FONTANA, California (Oct. 22, 2013) –  Three people are dead including a 2-year-old girl after a 3-vehicle crash Monday morning at the intersection of Citrus Avenue and Foothill Boulevard, according to a press release issued by the San Bernardino County Sheriff Coroner.

About 8:38 p.m., witnesses told police that the driver of an SUV sped through a red light, struck the driver of a blue truck and a third vehicle that were stopped at the traffic light.

The 2-year-old girl and a man who were in the third vehicle died at the scene of the crash. A 33-year-old woman was taken by ambulance to a nearby hospital where she later died of major injuries sustained in the crash at 10:14 p.m., the coroner said. Four others were injured in the crash, but details were not disclosed.

The Fontana Police Department is investigating the collision.

“The driver who caused this fatal crash must be held accountable for their actions,” said Attorney West Seegmiller. “These people did not deserve to lose their lives in this way because a driver was in a hurry to make the light or any other reason.”

Police will likely file criminal charges against the driver who ran the red light and caused the crash. The families of the victims killed in this crash and those injured, may file a civil lawsuit against the driver as well.

“There are always going to be reckless drivers on our roadways, however, the victims of these crashes should not have to suffer or struggle to pick up the pieces after such an incident,” Seegmiller said.

FONTANA: Hershel Trueblood, 62, of Fontana Killed in Bicycle Accident with Motorist on Sierra Avenue

Tuesday, July 23rd, 2013

FONTANA, California (July 23, 2013) – Hershel Trueblood, 62, of Fontana was killed Monday morning when his bicycle was struck by a vehicle on Sierra Avenue, according to a press release issued by the San Bernardino County Sheriff Coroner Department.

About 8:18 a.m., Fontana Police Department officials responded to the bicycle accident on Sierra Avenue near Fontana Circle. The police investigation determined that Trueblood was riding his bicycle when for unknown reasons he allegedly pulled in front of a driver who was traveling northbound on Sierra Avenue and was struck down.

Paramedics transported Trueblood to Arrowhead Regional Medical Center where he later died that same afternoon at 1:51 p.m., the report said.

The Fontana Police Department continues to investigate the circumstances surrounding the fatal bicycle accident. Witnesses are asked to contact the police department.

“Bicyclists who share the roadway with motorists are extremely vulnerable to injury or death,” said Attorney West Seegmiller. “Drivers need to be alert for bicyclists and pedestrians and allow a safe distance when passing them. The family of this man should hire an attorney to conduct their own investigation into the circumstances to determine liability.”

There were 31 people injured in bicycle accidents with motorists in Fontana in 2010, according to statistics compiled by the CHP Statewide Integrated Traffic Report. Additionally, there were nine killed and 532 injured in all Fontana crashes the same year including those involving pedestrians, motorcycles and drunk drivers, the report said.

FONTANA: Alex Perez, 49, of Fontana Killed in Hit-and-Run Pedestrian Accident on Citrus Avenue

Tuesday, July 9th, 2013

FONTANA, California (July 9, 2013) – Alex Perez, 49, of Fontana was killed Sunday night after he was struck by a hit-and-run driver in a dark-colored vehicle on Citrus Avenue near Foothill Boulevard, according to a press release issued by the San Bernardino County Sheriff Coroner Department.

About 9:40 p.m. on July 7, Perez was walking eastbound on Citrus Avenue when a driver hit him and he was critically injured. The driver fled the scene of the accident and did not stay to render aid to Perez as required under California law.

Paramedics transported Perez by ambulance to Arrowhead Regional Medical Center where he was treated by doctors, but he later died at 12:40 a.m. the following morning on July 8, 2013.

“Pedestrians, bicyclists and other motorists who are injured, as well as the families of those killed by a hit-and-run driver, may not realize that their own insurance policy’s uninsured or underinsured coverage may provide compensation for their losses,” said Attorney West Seegmiller. “An experienced personal injury attorney can help you determine if you have a case, as well as help you get the compensation you or your family needs to cover financial losses.”

The Fontana Police Department is investigating the fatal pedestrian accident. In Fontana, there were two people killed and 39 injured in 2010 pedestrian accidents, according to the latest statistics compiled by the CHP’s California Statewide Integrated Traffic Report. Also, there were a total of nine deaths and 532 injuries due to crashes in Fontana in 2010, the CHP report said.

California Pedestrian Accidents

Under California Vehicle Code Section 21950 (a) a driver must yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, said Attorney West Seegmiller, a California and Las Vegas wrongful death attorney. Also, drivers are required to slow down when a pedestrian is in the roadway and be alert for any crossings.

“There are exceptions in the law, however, such as pedestrians are required to watch out for their own safety,” Seemiller said. “This means they cannot suddenly leave a curb and walk or run into the path of a vehicle. Also, pedestrians should not unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.”

However, if a pedestrian does step into the roadway suddenly the driver must still make every effort to safely stop or avoid hitting them whether it’s a marked or unmarked crosswalk, Seegmiller said.

Pedro Almanza Jr., 24, and Daniel Andrade, 17, Killed in Fontana Car Crash

Monday, December 31st, 2012

FONTANA, California – Two passengers were killed Saturday night when the driver of the Honda Civic they were riding in lost control of the vehicle and was struck by a Ford Explorer on N. Riverside Avenue near Sierra Avenue, according to a press release issued by the San Bernardino County Sheriff Coroner Department.

About 8:08 p.m. on Dec. 29, Pedro Almanza, Jr, 24, of Rialto and Daniel Andrade, 17, of Rialto were reportedly killed in the two-vehicle collision, the coroner reported. The driver of the 2009 Honda Civic they were riding in and the Ford Explorer were both injured in the crash and hospitalized with undisclosed injuries.

Prior to the crash, the driver of the Honda was traveling in a southbound lane of N. Riverside Avenue, the coroner reported. Fontana Police do not know why the driver lost control, spun around and into the northbound lanes, but they are investigating the crash to determine what happened.

“The families of victims killed in a car crash can hold the driver responsible and liable for their loved one’s wrongful death,” said Attorney West Seegmiller, founder of The Seegmiller Law Firm. “Studies have shown that victims who are represented by an attorney typically obtain 3.5 times more in compensation for their losses than if they handled the claim directly with an insurance adjuster.”
