Encinitas Man, 46, Dies Two Days After Pedestrian Accident on El Camino Real

ENCINITAS, California – A 46-year-old Encinitas man was struck by a car about 9:30 p.m. Tuesday night as he walked in the intersection of North El Camino Real and Via Molena, according to a San Diego County Medical Examiner’s report.

A passerby called 911 for paramedics who transported the man to Scripps Memorial Hospital in La Jolla for treatment of multiple injuries. Upon arrival at the hospital he was admitted into the surgical intensive care unit. The following day, the man succumbed to his serious injuries and was pronounced dead at 4:16 a.m. Wednesday morning.

The man’s name has been withheld pending notification of his next of kin.

California Pedestrian Law

“Under California Vehicle Code Section 21950 (a) The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.

(b) This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.”

Laura Hall Killed, Four Injured in Multi-Vehicle 805 Freeway Rollover Crash in San Diego

SAN DIEGO, California – Laura Hall, 65, of La Jolla was killed and four others injured Wednesday morning they drove northbound on the Interstate 805 freeway near Sorrento Valley Road on their way to spend the day at Disneyland in Anaheim, according to a San Diego County Medical Examiner report.

Hall was riding in the back of a 2003 Toyota RAV4 about 6:37 a.m. when a 2005 Nissan Altima struck the car on the driver’s side and it spun out of control, flipped over several times and slammed into the center divider.  The vehicle came to rest teetering on the edge of the freeway about 30 feet above a freeway construction zone. Construction workers moved a forklift into position to hold the vehicle in place until help arrived.

The family was rescued from the dangerous ledge by the efforts of the San Diego firefighters, California Highway Patrol officers and tow-truck workers.

According to news reports, the crash resulted after the driver of the Nissan was swerving to avoid being hit by another vehicle and it struck the Toyota RAV4.  A third vehicle, a 2011 Toyota Tacoma was also struck and veered into a guardrail.

Paramedics transported Hall to Scripps Memorial Hospital where she was diagnosed with several internal injuries and admitted to hospital. Later the same morning at 10:33 a.m. she died of her injuries. Hall had been wearing a seatbelt at the time of the accident.

Hall’s son Brian D. Thomas, 43, of San Diego, was driving the Toyota and suffered several injuries in the crash including broken ribs, cuts, and bruises.  Also injured was his wife, Rebecca, 42, their son Bryan, 8, as well as Daniesha Thompson, 22, who all suffered non-life threatening injuries in the crash.

Police investigate every car accident involving a death to determine the cause of a crash, said Attorney West Seegmiller, founder of the Seegmiller Law Firm. SAN DIEGO, California – Pedestrian Jennifer June Suazo, 47, of  was struck and later died late Sunday night by the driver of a Nissan Armada as she ran across the 2800 block of Grand Avenue in Pacific Beach, according to a press release issued by the San Diego County Medical Examiner’s Office.

Suazo was struck about 10 p.m. and paramedics transported her to Scripps Memorial Hospital in La Jolla where she was treated for blunt impact injuries of the head, but died about an hour later at 11:20 p.m. the same day, the report said.

Pedestrians need to be especially cautious on our roadways because they are more vulnerable to injury or death. There were two pedestrians killed and 57 others injured in car accidents in Costa Mesa in 2009, according to the California Highway Patrol Statewide Integrated Traffic Report. In Orange County 41 pedestrians died and 864 were injured in 2009.

In California, there were 598 pedestrians killed and 12,418 injured in 2009, according to the CHP traffic report.

National data compiled by the National Highway Transportation and Safety Authority shows that pedestrian injuries and fatalities in the United States were up 4.9% in 2010 to 4,280 deaths and injuries were up 19% in 2010 to 70,000 people injured.

San Diego Rollover Crash on New Year’s Day Claims Life of James Cook of La Jolla

SAN DIEGO, California – After losing control of his 2010 Toyota Prius and rolling multiple times in the roadway, driver James F. Cook, 63, of La Jolla, was killed New Year’s Day despite efforts to save him at a local hospital, a County of San Diego Coroner press release said.

According to the press release, Cook was driving at “accelerated speeds” when he lost control of his vehicle in the 2700 block of Genessee Avenue, drove off the roadway and the car flipped over several times. The La Jolla resident, who was the sole occupant of the vehicle, was partially ejected and suffered blunt force neck and chest injuries in the horrible crash.

Emergency workers transported Cook to Sharp Memorial Hospital where they made “aggressive resuscitative efforts” to save his life, but unfortunately he died of his severe injuries, according to the coroner press release.

In California, fatal traffic accidents were down 12% to 2,715 deaths in 2010 compared to 3,090 killed in 2009, according to statistics compiled by the National Highway Traffic Safety Administration. Additionally, national statistics show that traffic fatalities have declined in recent years across the United States, down roughly 3% to 32,885 deaths in 2010 compared to 33,883 killed in 2009.
