WEST LOS ANGELES, California (July 25, 2013) – A child was struck and seriously injured by an SUV on the 1200 block of west 87th Street, according to a dispatch report filed by the California Highway Patrol.
Just after 6:30 p.m., CHP officers received a 911 informing them that a boy had been struck by a white SUV.
The reporting witness, the grandfather of the boy, said his grandson appeared “hurt very badly.”
Emergency officials arrived on scene, and paramedics transported the child to a nearby hospital, the extent of their injuries is unknown.
The accident is under investigation by the California Highway Patrol.
“Pedestrians are often times overlooked on the roadways,” said Attorney West Seegmiller of Seegmiller Law Firm. “Drivers are often times distracted on the roadways, and if you are someone you know are injured as a result of an accident that wasn’t your fault you should be properly compensated.”
Los Angeles Car Accident Statistics
There were 530 people killed and 50,153 injured in Los Angeles County car accidents in 2010, according to the most recent statistics compiled by the California Highway Patrol’s Statewide Integrated Traffic Report.
California Pedestrian Accident Law
Under California Vehicle Code Section 21950 (a) a driver must yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, said Attorney West Seegmiller, a California attorney. Also, drivers are required to slow down when a pedestrian is in the roadway and be alert for any crossings.
“There are exceptions in the law, however, such as pedestrians are required to watch out for their own safety,” Seemiller said. “This means they cannot suddenly leave a curb and walk or run into the path of a vehicle. Also, pedestrians should not unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.”
However, if a pedestrian does step into the roadway suddenly the driver must still make every effort to safely stop or avoid hitting them whether it’s a marked or unmarked crosswalk, Seegmiller said.
