SIMI VALLEY: Fireworks Injure 28 After Platform Topples Sending Rockets into Spectators

Friday, July 5th, 2013

SIMI VALLEY, California (July 5, 2013) – Some 28 spectators ages 8 to 78 were injured in a July 4 fireworks explosion Thursday night at a park in Simi Valley after the launching station toppled over during the show and set off a row of fireworks into the crowd, according to various news reports.

About 9:20 p.m., just a few minutes after the show started, fireworks began shooting sideways into crowds gathered to watch the show at the Rancho Santa Susana Community Center and Park, police said.

Ventura County Fire Department emergency workers treated many of the victims including children at the scene for minor injuries, but at least four were hospitalized with more serious non-life threatening burn injuries and broken bones.

The Simi Valley Police Department and the Occupational Safety and Health Administration (Cal OSHA) will likely conduct an investigation into the incident.

Roughly 10,000 people were at the park celebrating Independence Day. Initial reports indicate the fireworks display was held at the required 350 feet distance required by the fire code.

“Fireworks related injuries and deaths are not typically associated with public displays such as this one,” said Attorney West Seegmiller, founder of The Seegmiller Law Firm. “People attending these types of events have faith that every precaution has be made to ensure their safety.”

Police will investigate why the wooden launching station fell over to determine liability. Those who were injured in the fireworks explosion may experience lasting scars, pain and may have medical costs associated with the injury. Some may lose time off work or even have permanent injuries as a result of this incident.

“Indeed, we are very fortunate that no one was killed in this mishap,” Seegmiller said.  “Those who were injured, however, may be able to file a claim to recoup their financial losses against the city or event organizer who held this event.”

In fact, typical injuries from fireworks are burns to the hands, face and eyes. There are relatively few deaths resulting from firework explosions at all in the United States. Indeed, the bulk of the fatal accidents are the result of amateurs using illegal fireworks, according to the 2011 Fireworks Annual Report by the US Consumer Product Safety Commission.

The study analyzes fireworks-related deaths and injuries. The findings are gathered from sources including records from those treated at emergency rooms as well as law enforcement of illegal fireworks and news reports.

According to the CPSC report there were at least four fireworks-related deaths in 2011 and 9,600 injuries treated in emergency rooms across the United States. None of the deaths involved legal fireworks and all of the victims were male adults.  In fact, 68 percent of all injuries from fireworks were to males and children under 15 years old accounted for 26 percent of the total.

Sparklers and bottle rockets accounted for an estimated 1,100 injuries treated at ERs. Also, roughly half of the patients treated for fireworks-related injuries at hospital ER units suffered some sort of burns to hands and fingers (46 percent); head, face and ears (17 percent); legs (11 percent). Injuries to eyes involved contusions, lacerations and foreign bodies and accounted for about 17 percent of the injuries.

SANTA MONICA: One Killed, Several Injured in DUI Wrong-Way Driver Crash on 405 Freeway

Friday, June 28th, 2013

Two Drivers Arrested on DUI Charges After Both Vehicles Hit Car

SANTA MONICA, California  —  One person was killed and several injured early Friday morning after a suspected DUI driver on the wrong side of the road crashed his vehicle head-on into another car while driving on the westbound 10 Freeway near south Centinela Avenue and the 405 Freeway, according to a dispatch report issued by the California Highway Patrol.

About 1:15 a.m., CHP officers reported a driver in a red Ford Mustang was driving eastbound in the westbound lanes of the I-10 Freeway and struck a black sedan with multiple teenagers or young people. The Mustang then veered off the freeway and fell over an embankment.

Three of the young people in the black sedan were able to get out of the vehicle, but a fourth was trapped in the car. A third vehicle driven by a second DUI driver subsequently struck the disabled car and it burst into flames. The impact of the second collision is what likely killed the victim who had been trapped, witnesses told KTLA 5 News.

Emergency workers with the Santa Monica County Fire Department responded to the scene of the fatal crash and used the Jaws of Life to cut open the roof of the red Mustang that had plummeted over the side of an embankment and rescue the driver trapped inside, the CHP report said.

The wrong-way driver was arrested by Santa Monica Police on suspicion of felony drunk driving at about 4:30 a.m., the CHP reported. Police confirmed the driver had no injuries and was taken to jail. Police also arrested the second driver whose Hyundai crashed into the disabled car and killed a person. He was placed under arrest on suspicion of driving under the influence.

The multi-vehicle crash closed down the freeway for most of the night and was later completely reopened about 7:15 a.m.

CASTAIC CRASH: Two Children, Six Others Injured in 3-Vehicle Hit and Run Crash on I-5 Freeway at Parker Road

Thursday, June 27th, 2013

CASTAIC, California (June 27, 2013) – Two children ages 5 and 17 years old were among four people critically injured Wednesday afternoon when they were ejected from a gold 2003 GMC Yukon SUV after the driver attempted to avoid a crash with another driver on the southbound lanes of the Interstate 5 freeway just south of Parker Road, according to the CHP and reports by The Signal newspaper and The Daily News.

About 12 p.m., police reported that eight people were injured in the multi-vehicle crash and they are seeking the driver of a white SUV who allegedly caused the collision by making a sudden lane change next to the GMC, the Signal reported. Police are treating the accident as a crime and are seeking the public’s assistance in locating the driver of the white SUV.

Rodarte E. Arellano, 39, was driving the 2003 GMC Yukon with seven passengers all from Wasco in Kern County, The Daily News reported.

Witnesses told police the driver of the white SUV was traveling beside the GMC and began moving into its path at speeds upwards of 70 mph. Arellano reportedly attempted to avoid the collision and lost control of his vehicle, struck a center guardrail and rolled multiple times in the fast lane.

The drivers of a white Honda Accord and a white Ford Expedition who were traveling behind the GMC also crashed into the center divider, but did not hit the GMC.

Other victims included two women who were taken by ambulances to local hospitals while the children were taken to Children’s Hospital Los Angeles.

“The driver who caused this collision should turn themselves into police,” said Attorney West Seegmiller. “The victims of this accident may need ongoing medical assistance and care in order to properly recover from this crash.”
