Pedestrian Ernest Clark Struck Killed by Big Rig on I-10 Freeway

INDIO, California – Pedestrian Ernest Clark, 84, Moreno Valley was struck by a semi-tractor trailer truck Tuesday night as he stood next to his stopped sports utility vehicle at the shoulder of the westbound Interstate 10 freeway near the Cactus City Rest Area east of Indio, according to a press release by the Riverside County Sheriff-Coroner.

Clark was struck about 10:45 p.m. on the freeway just west of Frontage Road. Paramedics responding to the scene of the pedestrian accident transported him by Mercy Air Ambulance to Desert Regional Medical Center in Palm Springs where he died of his injuries about 12:40 a.m.

The report did not indicate why Clark was parked on the side of the road, but California Highway Patrol is investigating the pedestrian accident to determine what exactly happened.

“Pedestrians on freeways are extremely vulnerable to being struck by cars,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “It’s always safest to remain in your disabled vehicle until help arrives at the scene whether you are on a freeway or other roadway.”

Police officers will gather evidence using photographs, skid marks and other calculations to determine how the accident happened and whether the driver or the pedestrian was at fault in this tragic crash.

Pedestrians need to be especially cautious on our roadways because they are more vulnerable to injury or death. There were two pedestrians killed and 21 others injured in car accidents in Palm Springs in 2009, according to the California Highway Patrol Statewide Integrated Traffic Report. In Riverside County 39 pedestrians died and 370 were injured in 2009.

In California, there were 598 pedestrians killed and 12,418 injured in 2009, according to the CHP traffic report. National data compiled by the National Highway Transportation and Safety Authority shows that pedestrian injuries and fatalities in the United States were up 4.9% in 2010 to 4,280 deaths and injuries were up 19% in 2010 to 70,000 people injured.

SAN JACINTO, California — Karla Bracamonte, 29, of Moreno Valley was struck and killed Sunday night by the driver of a 2004 Dodge Durango SUV at the intersection of 7th Street just west of Grand Avenue

The fatal pedestrian accident took place at about 6:20 p.m. San Jacinto Police Department officers pronounced the young woman dead at the scene after aggressive efforts to resuscitate her failed. The driver of the SUV was not injured in the crash. Police closed down 7th Street from Grand Avenue to Pine Street for roughly 7 hours so officers from the San Jacinto Police Department’s Traffic Team could conduct an investigation to determine what happened..

California Pedestrian Law

“Under California Vehicle Code Section 21950 (a) The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.

(b) This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.”
