TUSTIN: Colette Upton, 46, Killed in Pedestrian Accident on SR-55 Freeway

TUSTIN, California (July 8, 2013) — Colette Upton, 46, of Moreno Valley was killed after being struck by the driver of a pickup truck on the northbound State Route 55 Freeway just north of 17th Street, according to a press release issued by the Orange County Sheriff Coroner Department.

About 5:50 p.m., Upton was a pedestrian on the freeway when she was hit by the motorist and died at the scene of the crash.  The driver remained at the scene of the fatal crash, but police did not disclose whether or not the motorist was charged with a crime.

The Tustin Police Department is investigating the collision to determine what exactly happened.

SANTA ANA: Fatal Pedestrian Accident on SR-55 Freeway at 17th Street

SANTA ANA, California (July 6, 2013) — A pedestrian was killed Saturday night after being struck by the driver of a white pickup truck on the northbound State Route 55 freeway near the 17th Street E. on ramp, according to a dispatch report issued by the California Highway Patrol.

Just before 6 p.m., CHP officers reported the driver pulled over following the crash and appeared to be cooperating with authorities following the fatal pedestrian accident. Police issued a SigAlert about 6:07 p.m., but it was later canceled at 8:23 p.m. once the roadway was cleared.

“Pedestrians are typically on the freeway because the person’s vehicle may have been disabled,” said Attorney West Seegmiller. “Motorists need to be extra cautious when pedestrians are present on any roadway and may be held liable for injuries or the death of a pedestrian if the accident is deemed to be their fault.”

Fed Ex Delivery Truck Kills Woman, 22, on Nutwood Avenue in Fullerton

Many Delivery Truck Drivers Under Pressure to Prioritize Speed Over Safety

FULLERTON, California (June 20, 2013) — Chelsea Kashergena, 22, of Fullerton was killed Thursday afternoon after the driver of a FedEx delivery truck driver struck her down as she rode her bicycle through a neighborhood.

The FedEx driver was reportedly traveling northbound on Ladera Vista Drive prior to the fatal 2:15 p.m. crash. Kashergena was headed eastbound on Nutwood Avenue.  The truck driver made a left-hand turn onto Nutwood when for unknown reasons the bicyclist was struck.

“Speed is the priority for these delivery truck drivers, whether it’s FedEx, UPS or another privately-owned service,” said Attorney West Seegmiller, “Pedestrians and bicyclists are most at risk as drivers barrel through residential neighborhoods searching for addresses  in these massive box trucks that are not designed for many smaller streets.”

Indeed, delivery truck drivers who work for large corporations are under high pressure to deliver packages to as many customers as they can in a short period of time. It’s no surprise that the accident rates of these companies are high and injuries and wrongful death actions are common.

Police say the FedEx driver involved in Thursday’s crash remained at the scene and cooperated with authorities. Additionally, the initial investigation reveals the bicyclist may have had the right-of-way.The family of this young woman will never be the same in the wake of this tragic crash, Seegmiller said.

There appears to be a system-wide failure among many service companies to put the public safety of pedestrians, bicyclists and other motorists ahead of the desire for bigger profits at many of these big corporations, Seegmiller said. The drivers of these box delivery trucks typically zip around neighborhoods as fast as possible in order to maintain tight schedules. It’s no wonder the Memphis-based FedEx Corp. is a billion dollar company whose net income grew 40-percent in fiscal 2012 to $2 billion, according to the company’s annual report.

“We as a community here in Orange County should all step up and make sure that something like this never happens to another person,” Seegmiller said. “Putting pressure on companies to put safety ahead of profits would be a start.”

SANTA ANA CRASH: Graciela Sanchez, 56, Struck and Killed by Driver Running Red Light

SANTA ANA, California (June 18, 2013) — Graciela Sanchez , 56, of Santa Ana was killed early Monday afternoon when a motorist ran a red light and struck her in the crosswalk at 1st Street, just east of Sullivan Street, according to news reports and the Orange County Sheriff Coroner.

Just before 11 a.m., Sanchez was walking near the intersection when she was struck by the driver of a white Volkswagen sedan allegedly drove through a red traffic light and she was critically injured. Paramedics transported Sanchez by ambulance to UCI Medical Center in Orange where she was treated, but she died at 12:06 p.m. the same day, the report said.

The Santa Ana Police Department is investigating the fatal pedestrian accident to determine whether criminal charges will be filed or not.

Luis Adrian Torres, 19, Killed, One Hospitalized on Susan Street in Costa Mesa Crash

COSTA MESA, California (June 17, 2013) – Luis Adrian Torres, 19, was killed and his female passenger hospitalized early Sunday morning after crashing into a tree on Susan Street near Sunflower Avenue, according to a report by the Orange County Sheriff Coroner and the Daily Pilot.

About 12:36 a.m., emergency workers spent roughly an hour ripping apart the 1990 Jaguar XJ-6 to get to the injured driver because the car had wrapped around the tree, according to a KABC news report.  Torres and his injured female passenger were taken by ambulance to Western Medical Center in Santa Ana where they were treated. Torres did not survive the accident and was pronounced dead about 4:30 a.m., the coroner said.

The Costa Mesa Police Department is investigating the crash to determine what happened. The Daily Pilot reported that the driver was an Estancia High School student.

“Sadly, there are no words that can comfort this man’s family and friends as they cope with such an incredible loss,” Attorney West Seegmiller said.  “The thoughts and prayers of our staff are with them as they try to piece together what happened and come to terms with his death.”
