ANAHEIM PEDESTRIAN ACCIDENT: Kym Murphy, 54, Killed in Crash on Euclid Street

Tuesday, May 28th, 2013

ANAHEIM, California (May 28, 2013) — Kym Murphy, 54, of Anaheim was killed Saturday afternoon when she was struck by the driver of a silver sport utility vehicle while crossing Euclid Street near Chateau Place, according to a press release issued by the Orange County Sheriff Coroner Department.

Murphy was reportedly walking westbound on Euclid Street when the driver struck and injured her. She was taken by ambulance to UCI Medical Center in Orange where she later died from injuries sustained in the pedestrian accident at 2:49 p.m. the same day, the coroner said.

The Anaheim Police Department is investigating the fatal pedestrian accident to determine liability for her death.

Orange County Pedestrian Rights

Under California Vehicle Code Section 21950 (a) a driver must yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, said Attorney West Seegmiller, a California and Las Vegas wrongful death attorney. Also, drivers are required to slow down when a pedestrian is in the roadway and be alert for any crossings.

“There are exceptions in the law, however, such as pedestrians are required to watch out for their own safety,” Seemiller said. “This means they cannot suddenly leave a curb and walk or run into the path of a vehicle. Also, pedestrians should not unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.”

However, if a pedestrian does step into the roadway suddenly the driver must still make every effort to safely stop or avoid hitting them whether it’s a marked or unmarked crosswalk, Seegmiller said.
