VICTORVILLE: Richard Story, 55, of Carlsbad Killed, Driver Critically Injured in US 395 Head-on Crash

Tuesday, August 13th, 2013

Car Crash on US 395 Highway Kills Man in Victorville, California.

San Bernardino Personal Injury Attorney Reports on Fatal Victorville Crash on US 395

VICTORVILLE, California (August 13, 2013) –  Richard Story, 55, of Carlsbad was killed and another driver critically injured in a head-on car crash on US Route 395, just south of Luna Road, according to a press release issued by the San Bernardino County Sheriff Coroner Department.

About 9:44 p.m., Story was driving a Volvo sedan in the northbound lanes of the SR 395 when the driver of a BMW who was heading southbound veered suddenly into opposing traffic and struck the Volvo head-on, the report said.

Paramedics were called to the scene of the traffic accident. Story, however, was pronounced dead at the scene and the other unidentified driver was taken by air ambulance to a nearby hospital. The two-vehicle crash is under investigation by the San Bernardino County Sheriff’s Department.

“The US Route 395 is an especially deadly stretch of roadway,” said Attorney West Seegmiller. “Drivers are often fatigued as they undertake long journeys on this roadway and may find themselves drifting into opposing traffic. Police will investigate what exactly happened in this accident to determine its cause.”

Indeed, police take many steps following a fatal or serious injury crash to determine liability including taking measurements, photographing the accident scene, speaking with anyone involved in the accident as well as witnesses and create a police report. Depending on their findings, a driver may be cited for reckless driving, speeding or some other traffic violation.

Ultimately, police will determine who they believe is liable for the crash. Most crashes are accidents, but some involve negligence on the part of one or both drivers. For example, a person who falls asleep while driving is negligent because they should not have been on the road if they were not alert and able to drive safely. On the other hand, a person who loses control of a vehicle due to an unknown mechanical error may not be found negligent, but still held liable if they injure someone else in a crash.
