Tuesday, March 5th, 2013

SAN DIEGO, California (March 5, 2013) — Toffin J Kulevich, 82, of San Diego died early Saturday morning roughly four months after being struck and injured in a pedestrian accident, according to a report by the San Diego Medical Examiner.

On Oct. 29, 2012, Kulevich was struck by a car and sustained multiple fractures at an undisclosed location in San Diego, the report said.  Paramedics transported the City Heights man to Scripps Memorial where he was treated for his injuries and later transferred to Kaiser Hospital and a skilled nursing facility. Nanny Pushing Stroller Killed, Infant Injured in San Diego Crosswalk Accident

Tuesday, February 5th, 2013

SAN DIEGO, California (Feb. 1, 2013)  – Monserrat Mendez, 41, of San Diego was killed and a 13-month-old baby she was pushing in a stroller was critically injured Friday after the two were struck by the driver of an SUV that allegedly failed to stop for them at a crosswalk on Camino Del Sur in Black Mountain Ranch, according to a San Diego Medical Examiner report and news sources.

Just before noon, Mendez who was the baby’s nanny, was pushing the infant’s stroller in a marked crosswalk near Via Verrazzano when the driver of a Toyota 4Runner traveling northbound on Camino Del Sur reportedly crashed into them.

The impact threw Mendez and trapped the baby in the stroller underneath the SUV.  A witness riding a bicycle came rushed to the scene of the pedestrian accident and pulled the baby out from under the vehicle. The baby was transferred by paramedics to a nearby hospital where the child was listed in critical condition.

Police are investigating the circumstances surrounding the fatal pedestrian accident to determine liability.

“This woman was walking in a marked cross walk with an infant and the driver failed to yield the right-of-way to a pedestrian,” said Attorney West Seegmiller. “Under California law the driver will likely be found liable for her wrongful death and for the injuries sustained by the child.”

Elana Huerta, 81, of National City Killed in Hit and Run Pedestrian Accident

Monday, January 7th, 2013

NATIONAL CITY, California — Elana Huerta, 81, of National City was struck and killed by a hit-and-run driver Saturday night while she was crossing in the 1900 block of Highland Avenue, but the following day the driver turned himself in to police, according to a press release issued by the San Diego Medical Examiner and Fox 5 News.

About 6:23 p.m. on Jan. 5, 2013, Huerta was pushing a metal cart mid-block across Highland Avenue near East 19th Street when a driver in a maroon van struck her and she was thrown into the roadway, the report said. The driver never stopped to render aid to Huerta and fled the scene, witnesses told police.

Witnesses called paramedics to the scene of the hit-and-run pedestrian accident and they transported the victim by ambulance to University of California San Diego Medical Center on Arbor Drive in San Diego. By 10 p.m., Huerta had died from her injuries at the hospital.

The next day, police arrested Alejandro Lomas Hernandez, 44, of San Diego when he came to the police station to admit to the crime. Hernandez was charged with vehicular manslaughter, hit-and-run resulting in death, vehicular manslaughter with gross negligence, and driving without a license, Fox 5 News reported.

“When someone is injured or killed by a hit-and-run driver they or their survivors may in some circumstances obtain compensation for their medical costs and financial losses if they themselves have automobile insurance with uninsured or underinsured motorists on their policy,” said Attorney West Seegmiller, founder of the Seegmiller Law Firm. “A San Diego personal injury attorney can explain this better and assist victims of hit-and-run drivers under certain circumstances.”
