BMW Crashes into Alpine Bus Stop on Tavern Road Pedestrian Hospitalized

Thursday, April 11th, 2013

ALPINE, California (April 11, 2013) – A person waiting at a bus stop bench was hospitalized Thursday morning after being struck by a passenger car on Tavern Road at Alpine Boulevard, according to a dispatch report issued by the California Highway Patrol.

About 11 a.m., CHP officers were called to the scene of the crash where the driver of a white BMW sedan struck and injured a pedestrian waiting at a bus stop. Heartland Fire Department was called to the scene of the crash.

The pedestrian suffered serious injuries in the crash and was transported by paramedics in an ambulance to a nearby medical facility for treatment.

“Police must conduct an investigation into the circumstances surrounding this pedestrian accident, but the victim should consider hiring their own personal injury attorney to ensure they are adequately compensated for their financial losses,” said Attorney West Seegmiller.

SAN DIEGO PEDESTRIAN ACCIDENT: Man, 53, Killed on El Cajon Boulevard

Thursday, April 11th, 2013

SAN DIEGO, California (April 11, 2013) — A 53-year-old San Diego man was killed early Thursday morning after a small white car struck him as he attempted to walk across El Cajon Boulevard near Idaho Street, according to a press release issued by the San Diego County Medical Examiner.

About 1 a.m., the male pedestrian was reportedly trying to cross El Cajon Boulevard in the 2800 block outside of a crosswalk when a 30-year-old driver traveling eastbound in the No. 2 lane struck him, the report said. Witnesses called 911 to report the crash and stayed with the man until paramedics arrived. Paramedics tried to help the San Diego man, but he was pronounced dead roughly 15 minutes after the crash.

Under California Vehicle Code Section 21950 (a) a driver must yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, said Attorney West Seegmiller, a California and Las Vegas wrongful death attorney. Also, drivers are required to slow down when a pedestrian is in the roadway and be alert for any crossings.

“There are exceptions in the law, however, such as pedestrians are required to watch out for their own safety,” Seemiller said. “This means they cannot suddenly leave a curb and walk or run into the path of a vehicle. Also, pedestrians should not unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.”

However, if a pedestrian does step into the roadway suddenly the driver must still make every effort to safely stop or avoid hitting them whether it’s a marked or unmarked crosswalk, Seegmiller said.
