SAN BERNARDINO, California – Adriane Dolan, 43, of Upland faces charges of auto insurance fraud after a police investigation revealed the woman filed a claim for a car accident during a period where her coverage lapsed, according to a press release by the San Bernardino County District Attorney’s Office.

The San Bernardino County District Attorney’s Office Auto Insurance Fraud Unit investigated Dolan’s claim after finding a discrepancy between the date of the accident and the police report. Dolan had been awarded a substantial insurance settlement after a family member was in a traffic accident, but police found she had allowed her policy to expire during the same time. She had paid the policy, made the claim and took the settlement after making false statements to the insurance company, the report said.

Dolan faces up to six years in county prison if she is convicted on all counts against her, according to the report.  She is being charged under Penal Code Section 550 (b) (1) and (3).

 

PENAL CODE SECTION 550(b)(1)It is unlawful to do, or to knowingly assist or conspire with any person to do, any of the following:(1) Present or cause to be presented any written or oral statement as part of, or in support of or opposition to, a claim for payment or other benefit pursuant to an insurance policy, knowing that the statement contains any false or misleading information concerning any material fact.
PENAL CODE SECTION 550(b)(3)Conceal, or knowingly fail to disclose the occurrence of, an event that affects any person's initial or continued right or entitlement to any insurance benefit or payment, or the amount of any
benefit or payment to which the person is entitled.
