Do We Have a Right to Privacy?

The United States Constitution protects our right to free speech, our right to remain silent and our right to a speedy trial, but does it give us a right to privacy? There is no specific right to privacy provided under federal law, however, every state has its own constitution with laws that are created specifically for its citizens. The California constitution, for example, is one of the states that does provide its citizens with the right to privacy. Attorney West Seegmiller will discuss this and more including cases in the news. He also answers calls from listeners throughout the show. Many people fall in love with their soul mate, get married and live happily ever after, but for a large percentage of those who marry the dream ends in divorce. Typically, couples who divorce fight over money issues. One’s the spender and one is the saver. Legionnaires Disease Still a Threat

Nearly 40 years ago, a deadly bacteria outbreak quickly spread through the Bellevue Stratford Hotel in Philadelphia, Pennsylvania killing 34 people and sickening another 230 more at a gathering of members of the American Legion. The outbreak, which spread rapidly through the hotel’s air conditioning system, was a deadly new bacteria strain with similar symptoms to pneumonia. Legionnaires Disease, as it was called, has since made headlines once again in Chicago this past summer where three people died after contracting the disease through contaminated water at the JW Marriott Chicago hotel. At least 10 died in Quebec, Canada in a September outbreak. Attorney West Seegmiller will talk about liability for illnesses such as Legionnaires’ disease and whether a property owner can be held strictly liable for injuries or deaths resulting from negligent upkeep of a premise. In the wake of the recent electrocution tragedy in Valley Village, California on August 22, 2012, Attorney West Seegmiller discusses liability for personal injuries and wrongful deaths. Two people were killed as they went to rescue a man whose vehicle knocked over a light pole and a fire hydrant, but they were electrocuted during their rescue attempt. Plastic surgery is pervasive in our society. There’s some amazing results out there, but even celebrities can have something go wrong. We’ve all seen people with “frozen faces,” “pixie ears” or extremely large lips called the “trout pout.” Dr. Randal Haworth, MD, one of Southern California’s top plastic surgeons, is guest on this week’s West of Legal radio show. Dr. Haworth his own practice in Beverly Hills and is also on staff at Cedars Sinai Medical Center in Los Angeles. A specialist in facial surgery, rhinoplasty and breast augmentation, Haworth was one of two plastic surgeons who appeared on the hit Fox television reality show The Swan for two seasons. Traumatic Brain Injury

Dr. Rosemarie Scolaro Moser, PHD, and neuropsychologist and author of the book “Ahead of the Game: A Parent’s Guide to Youth Sports Concussion.” joins West as a guest on this week’s West of Legal show. Moser, a brain-behavior expert, talks with West about sports-related concussions or mild traumatic brain injuries. These sports-related injuries, which are mild TBI, affect young children differently than adults. Girls are more susceptible to these injuries than boys. Many people are unaware they even have such an injury sometimes until 24 to 48 hours after they are hit. Here in California, those who walk, run or venture out on the roadways are especially vulnerable to being injured or killed in a traffic accident. In fact, one in five fatal traffic accidents in California are pedestrians. That’s roughly 23% of all traffic accident deaths that were pedestrians. Sadly the number of deaths has been on the rise. Statewide statistics show a 5.4% increase in pedestrian deaths to 599 in 2010 compared to 567 deaths in 2009. About the Radio Show Host
Prior to becoming a legal radio talk show host, West Seegmiller earned a reputation as an authority on personal injury law over the past three decades handling thousands of cases for client and winning settlements of more than $100 million. A graduate of the McGeorge School of Law University of the Pacific in Sacramento, Seegmiller began earning a name for himself in college as he was selected to compete in the highly competitive Traynor National Moot Court Team and became a member of the prestigious Pacific Law Review. Later, Seegmiller began his practice and quickly became a noted lawyer in the field of personal injury. He continued his education at the Harvard Law School Program of Instruction for Lawyers, as well as The Jerry Spence Trial Lawyers College. Over the past 10 years, he has served as a Pro Tem judge for The California Superior Court and was proud to become a member of the Million Dollar Advocates Forum as well as the Member of the Multi-Million Dollar Advocates Forum.
